    Like Katiespringer, I'm due in Court next Friday 3rd August. In light of the new announcement, I don't know whether we should still turn up..?

    I happen to know that Lloyds TSB is asking the courts to suspend all of their cases until the test case is complete, which could be 1 year! I can only assume that the other banks involved (such as HSBC who I am claiming from) are taking a similar stance...
    hi rang the courts today to see if court dates are to be put on hold, was told that they are carrying on as normal
  • Following the recent announcement on the site I wondered if anyone knows if banks are still progressing ongoing / agreed claims or not.
    I had received an offer from the bank agreeing to settle my claim in full. I sent the acceptance letter back and this was received by the bank on 17 July, the letter said the payment would be put into my account within 14 days and when I spoke to the bank at lunchtime today I was told the letter had been received and the payment will be in my account on the 30th or 31st July.
    I saw the announcement on the site an hour after this conversation and am now unsure if the bank will still make the payment or not as the customer service assistant I spoke to didn't mention anything about the announcement. Does this mean claims that had been agreed prior to this will still be honoured?

    I'd appreciate any help people can give me.

    What caos this has all turned into, people are frantic for answers.

    From what i have been reading it looks like if you have received an offer then they will honour it still. Looks like you were just in time. I received my payout at beginning of week thankgod, think i would be having a nervous breakdown if hadn t. Feel so sorry for everyone that are in this position at mo:confused: all so relying on this money tohelp get them out of debt.

    I would ring them just to confirm that they are still crediting your account but i think from what i have read you should be ok

    HI

    I have been claiming my charges back since feb 07

    I have got to the final stages with the bank of scotland and we have agreed through the ombudsman a settlement which was agreed 30.06.07 and i sent my acceptance which was recorded and they then sent the acceptance to the bank which was also recorded on the 13.07.07.

    I have been on the phone every day since asking for the money to go into my account since the 13.07.07 and i have benn getting the run around .

    After contacting th ecomplaints manager who fails to return your calls i was advised that my money is actually on hold until the test case is completed.

    The bank are stalling people and it seems that we are the only people that have to comlply to dates set by them.

    I want my money and i am on the phone every day atleast 3 times a day and i wont rest until the put my charges into my account

    report them to financial ombudsman. i received an offer from halifax 2 weeks ago sent acceptance letter same day. received confirmation last week from fo that halifax had been notified and have got 6 weeks to pay. i've just got off the phone with fo and they say if you have already accepted an offer the bank will have to pay. (dont have to wait for test case). if they don't the fo will take it on as a new complaint. not as a bank charge complaint but failing to keep to an agreement.

    Taking Nationwide to court,just received communication from the court stating that the "Allocation questionnaire be dispensed with in this case",has this any significance or is this normal practice?
    Anyone help?

    I've just phoned HSBC again and they've confirmed the money I claimed has been paid into my bank this afternoon and should show on my account tomorrow; as this was agreed prior to the announcement and the case wasn't going to court. So it looks like HSBC are still honouring agreements they've already made to people.
    Phew, but looks like you were right, I got my claim in just in time. Glad to hear you were successful too.

    Thankgod for that, bet you are so relieved. Up til yesterday we were all waiting up til midnight for our monies to go in from hsbc as this is the time they put charges back in. Now it looks like they are rushing to clear the whole backlog of claims by doing them in the days. Hope there are a few more that are successful to have waited eight weeks plus then to be told NO is just plain torment.

    If the banks have already sent you an offer and you have/are accepting it, they are honouring the offers, you have 8 weeks from the date of the letter of offer to accept....Only people at the letter stages with the banks have been put on hold, as far as am aware, anyone already at court stage this is clearly still going ahead people have telephoned the county courts and have been told that their cases are still being heard.

    Any ideas about the people who have been promised letter of offer this week whether they are still honouring them, i have a friend on here whose eight weeks is up in a few days and they promised her a couple of days ago that an offer would be sent?
