    court case has been set aside for the !!13 august }:eek: :eek: and i need to have a my details in order just in case
    and know what to say and do :eek: !!!!!!!!

    the Court letter saying..

    1 the claim be allocated to the small claims track

    2 the claim be listed for further directions only at a preliminary hearing to take place on the 13 aug

    3 at this hearing the court will consider either :

    to stay the claim pending the decision in a test case :eek: involving the defendant ,or to give directions for this claim to be heard as a test case and if necessary to reallocate the claim to the multi track for that purpose

    4 not less than 14 days before the preliminary hearing, the defendant shall file with the court and serve upon the Claimant details of any cases proceeding as a test case, the decision in which will determine the issues in this claim. Alternatively, the defendant shall file with the court and serve upon the claimant draft directions for this case to proceed as a test case.

    5 The claimant may make any representations to the court in writing provided these are received by the court and served on the defendant not less than 5 days before the preliminary hearing. If either party is prepared to abide by the decision of the judge as to directions to be given, that party is excused from attending the preliminary hearing.

    The story: I went to court and won! has this happened to anyone else?

    I've been waiting for the Abbey to settle since I first started my claim in January 07. They kept playing for time, offered me half, then played for time again. Court date was set for 4th June but I thought they'd pay up before it got that far but they didn't. Right up to the post man coming on the 4th, I thought they would pay up - but no! Imagine my horror when I realised that I definitely would have to attend court. Thanksfully I had all the paper work ready just in case. I went for my appointment at the County Court and guess what! The Abbey didn't turn up. No surprise there. So the judge awarded in my favour!! The Abbey have to pay back all the charges plus the court fee plus travel expenses.

    For those of you who are still trying, don't give up - don't be worried about going to court, it was scary and I felt unqualified to defend myself but I did it and it felt great! The judge seemed quite stern at first but he admitted that he was playing devil's advocate and was quite nice in the end. He even put my travel expenses on the bill that will be going to the Abbey. If anyone wants to know the sort of things I was asked, just fire away. I'm on top of the world tonight and dead proud of myself for not giving up.

    I am due to go to court on 3rd August to pursue a claim and like other people I am nervous about going. Could you give me some clues as to what questions the judge is going to ask.

    Hopefully the bank will pay up just before the due date.

  • hi there I had a court date for the 17th aug but this has now been changed to 2nd oct, what did you take to court to defend your case. i,m fighting for a fee of £4800, and am getting a little aprehensive. all thoughts welcome

    Definately!..... No excuses that they didn't get the letters or blaming the poor old postman then!:D

  • Don't know if anyone has any advice they could give me. I have been chasing the Alliance and Leicester for charges only totalling £348.00. They came back and said they would give us £44 back. I sent the next letter stating I would be prepared to accept £250. They have today written back saying they are not prepared to pay and suggesting we might go to ombudsman. Has anyone else had this predicament. Any help would be appreciated.

    Sent 1st letter downloanded from bbc website, bank replied unwilling to refund charges, without delay i went to the local county court to submit a claim against halifax, within a week halifax wrote to me offering to refund me the full amount within 5 days & asking me to withdraw my court claim on receipt of my payment. Brilliant.......... i was overjoyed!
  • For Footsie 330, having just had success with the Alliance & Leicester myself, I suggest you ignore their suggestion of the Ombundsman & go straight for the court forms & send them off. It will probably be quicker. Good Luck.
