Reclaim Unfair Bank Charges article discussion Part II

Seems you're in the habit of agreeing T&Cs, then operating your accounts in such a way as to incur charges and yet feel for some reason you should not have to pay for your actions. Unlike many of us who have operated our accounts responsibly and accordingly haven't incurred these charges.[/quote
reading your comments offended me as i'm sure it did to others. yes i agree that there are some people who are totally irresponsible but there are others like myself who get into financial difficulty through unforseen circumstances. my problems started 6 weeks after we bought our first home when my husband was made redundant without any redundancy money. we couldn't claim off the payment protection insurance as claims weren't allowed until after 8 wks. even when the 8wks had passed we were still unable to claim because the redundancy was prior to this. my husband was out of work for several months and the bank charges were starting to be applied. we were being charged for an unauthorised o/d when it was one of their charges which made us go overdrawn. and the cycle continued and snowballed.
i think you seem to be missing the point. we are not disputing the fact of being charged in the first place because it is part of the t&c's but what we are all disputing is the value of these charges. these charges should be in proportion to what it actually costs the bank when a d/d fails and a letter is sent out etc. if the banks had been acting lawfully in the first place then i dare say many people would not be in the financial difficulty that they are now.
so for everyone who has had banks unlawfully take money from you - GOOD LUCK and keep going.
as you johnllew, congratulations on managing your account so well. lets hope you never have to be in the same boat as the rest of us.
Why is "johnllew" using this forum if he is so smart ???
It's probably a wind up from some jerk who has nothing better to do, someone like a bank employee WHO IS SO FED UP refunding us all that money, he/she is very bored.
Debs, take NO notice, as they say "ignorance is bliss" and write OFF "johnllew" as one of those OKThe Winner Takes it All0 -
Hi. Just a quick question. Im at the stage with Barclaycard where they credited the difference between 12 and 20 pounds onto my card without notification. I then sent a letter saying I accepted as part payment without prejudice etc but that i intended to claim the remaining amount through the court system. Now i am intending on completing the Mcol this week and I am a bit confused about whether i claim the full amount and mention that part payment has been received in the particulars or just claim for the remaining figure without mentioning the credited amount. Anyone else had any joy after having received a part payment?

Apologies if I have posted this in wrong thread or incorrectly - I am not familiar with forums, but wondered if any body had any feedback.
I have received the statements from Barclays, totalled up the unfair charges - added interest - and requested full repayment (only £930) on 25th June asking for response within 14 days (all as per the usefull templates provided).
Received response from Barclays on 3rd July stating that my compliant has been recorded and whilst they will endeavour to find a solution they cannot gaurentee within 14 days - but will reply within 4 weeks.
Have now received a second letter on 21st July stating still ongoing - we'll get back to you within another 4 weeks i.e. 22nd August.
Can those of you in the know advise if this is normal, or am I getting the run around, what else can I do to move this forward?
Appreciate any help / advice.

I recently received successfully my charges back of over £5000 and my advice to you is simply stick to your timescale to which you threatened in your letters, as YOU are the one threatening suing THEM not the other way round!! the bank will string you a story all day long if they can, hence why people are waiting months just for the statements!!elysiumplat1num wrote: »Apologies if I have posted this in wrong thread or incorrectly - I am not familiar with forums, but wondered if any body had any feedback.

So if I've understood you right - I should now zap them the next template letter (step 4) to threaten to take them to court because they have not settled or provided acceptable response so far?
Cheers0 -
Correct, they have replied to you stating another timescale which is different to what you stipulated in your original letter, though they have had the decency to reply to you they have not offered you your money back, they are just delaying the timescale you set......always remember YOU ARE SUING THEM FOR UNLAWFULLY TAKING YOUR MONEY.
Good luck and i look forward to reading your success story shortly0 -
Right ok - I'm getting that in the post now.
Thanks very much, appreciated0 -

use the bank charges calculator in the free tools section to the right of your screen..you dont really need to do this yet, you basically just add up the charges you are claiming and tell them you will be claiming interest @ 8% P.A.i have just recived a reply to my letter giving me a list of all my charges from last 6 years and am about to ask them to refund me but how do i calculate the interest on the amout?
