Reclaim Unfair Bank Charges article discussion Part II

I am helping a friend start the reclaiming process. Unfortunately he has no record of the account number of an account he wants to claim charges back from.
He has written the first letter asking for statements giving his full name and date of birth but he has had no luck. They have said they cannot provide statements as he has not provided bank account details.
How can he get his account number? The account was closed around 2 years ago.0 -

Started the whole process a good couple of months ago. All previous letters ignored so i thought it would have to go to court. I had to delay court by about a week as it fell just short of payday. Well on the day i was due to file i got the settlement letter to sign with the above offer. Funny thing was, was that in the second letter i sent them i put a lower amount that i would accept, £2300.
Just one question, how long between sending back acceptance letter and getting cheque (account has been closed over a year)
I have just had an issue with Lloyds where they offered, I accepted but am still waiting. They claim they are 4 weeks behind opening the mail before processing payments. Interesting how fast they open mail from the Courts though isnt it ! So, I said I would re-open proceedings in 24 hours if they didnt pay up. Just had a call to say the money will be in my bank in 24 hours as opposed to the original 6 weeks they quoted me.
Stick to your guns, play hardball, do NOT fall for delay tactics - its YOUR money and you have WON !!!!:beer:0 -
It is important that you and everyone ALWAYS ask the bank in writing "Please explain how you arrive at your charges and give me a full breakdown of your calculations".
We all know the banks will not do this but if they do not give you the answer, it is a letter than can be shown to the Judge on the basis that you have tried to obtain the information but the bank has ignored you.
Thanks for the advice cyberman; I'll definately ask them but won't hold my breath for a response.

RBS who over six years have taken over £3500 in charges from my account.I still have charges disputes to settle - Capitol One, Egg but should they prove unwilling to refund, I'll be using the Financial Ombudsman. It takes longer but I still have the option of court afterwards should they fail to reach a settlement!
Seems you're in the habit of agreeing T&Cs, then operating your accounts in such a way as to incur charges and yet feel for some reason you should not have to pay for your actions. Unlike many of us who have operated our accounts responsibly and accordingly haven't incurred these charges.0 -
I am in the process of filling out the court questionaire. My reply from the defendant was that not enough detail was included in the original claim.
I am aware that i can submit another form requesting i be allowed to add detail however can i submit a detailed list of charges (dates, cost & reasons) with the questionaire. I can include the information in part G where it asks for further information. I am asking Barclays bank to provide a detailed breakdown of their costs incurred too. This is beginning to concern me as the process was supposed to be simple however £120 + £100 is beginning to look like a bad investment.
I would appreciate any assistance as it is a worry now.

Have you been told by the court that its a Direction Hearing, usually it says in the letter it will take 5/10 minutes? It certainly sounds like its not a full hearing and its where the judge will consider several applications as to wether they go to a full hearing.

Hi guys, i got my "intend to defend" letter through from SCaM the other day followed by a full settlement letter of £5726.53p the very next day, my question is this: How long on average does it take for Lloyds to transfer the settlement figure into the specified account? Any help would be appreciated.0
