Does any one know how long it takes for the money to be paid into your account after sending an accpetance letter back to SCAM.
I send my letter back (accepting just over £4500 :j ) 2 weeks ago today, i called them last week and they said it takes about 10 days. The money is still not in my account
I want my money!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
I'm in the same boat as you, told me today that it takes 2 - 3 weeks!!!0 -
Spoke to HSBC on the telephone today to give them a bit of a nudge. The gent on the line informed me that a letter was on its way to me offering £1489.20 in full and final settlement (I had asked for £1800). I first wrote to them on 06/06/07, so it has taken just over 6 weeks to receive an offer. If you are not looking for the full amount of your claim then waiting with the 8 weeks, with the occasional telephone call, is well worth it.
Re: the A&L, I have just sent off my complaint to the Ombudsman. I am not expecting the same expeditious result.0 -
Hi all,
1st posting here and great site Martin!!:T
I sent my first letter on the 1/6/07 and then recieved a reply within 2 weeks from HSBC requesting I itemise each and every charge made in the last 6 years. I finally got round to doing this this weekend just past and was ready to send off my 2nd letter to them today until a letter dated the 19/7 arrived today.
The second letter from HSBC today offering £2559.15 when I asked for £2866.00 in total bank charges. I stupidly forgot to add interest on this amount in my first letter.
Should I accept this? or push for a little more? My account is already very overdrawn and the money will help toward it. Am I also correct in saying I can't reclaim debit interest?
Thanks in advance0 -
I am a new member with a 19 year old son who has aspergers syndrome and is not good with his money. He has an account at nationwide where he has no overdraft facility yet they allow him to go overdrawn and then charge him for the privilege. Can anyone advise me how to stop Nationwide doing this. I am in the process of reclaiming charges for him.0

...and Abbey didn't turn up as expected. The district judge had previously ordered that they serve upon me and the court 14 days prior to todays session (which was a five minute preliminary to decide if it should be refered as a test case), details of any test cases proceeding which would determine the outcome of my case, or to give draft directions for the case to proceed as a test case. Wonder what will happen as they have failed to do this???
The judge gave me the choice of either multitracking as a test case which then puts me at risk of substantial costs should I fail or to refer to a circuit judge and remain in the small claims track. I have chosen the latter. He also said that the outcome would probably (but not always) become the precedent to other circuit judges in that they usually go with their decisions whereas district judges tend not to.
Oh well now awaiting the date to see the circuit judge. :eek:0 -

Phil, this is now getting very interesting as the Judge was trying for a test case. The courts are so fed up with the bad behaviour of these banks that sooner or later the bubble will burst.
It is important that you and everyone ALWAYS ask the bank in writing "Please explain how you arrive at your charges and give me a full breakdown of your calculations".
We all know the banks will not do this but if they do not give you the answer, it is a letter than can be shown to the Judge on the basis that you have tried to obtain the information but the bank has ignored you.The Winner Takes it All0 -
Hi all,
Update on my claim, got statements online and worked out charges to £3368 sent first letter claiming this plus interest on 05/03/07, recieved usual letter from Mr Langdale, dealing etc etc on 16/03/07, made a couple of phone calls but didn't follow up due to lack of finances and did not want to threaten court and not be able to follow it through, when finally in a position to carry on it was about 7 weeks after first letter, looking at a lot of hsbc threads it seem that people were filing online then getting offers after about 8 weeks, so thought would leave it for the 8 weeks, Hsbc stated that they started investigation into complaint on 12/03/07.. made phone call on 08/05/07 ready to carry on and was told that a offer letter had been sent that day, recieved letter dated 08/05/07 on 10/05/07 offering £2830.93. Phoned leeds on 14/05/07 to be told that it could not be discussed over the phone and i had to sent a refusal letter in and it would be reviewed. not happy with this phoned again about an hour later and different person told me that they would put me on the ringback list but it would take up to 48 hrs. Phone this morning and was told that I was on the ringback list but it was only put on it on 15/5/07 so expect a call tomorrow... 20 mins later recieved call from hsbc to discuss claim, told him i was not happy with offer and that the £85 of charges that they said I had been paid back I had not, he rechecked it for me there and then and apologised and said they had made a mistake, then offered me £3000, asked for £3300 and he said he could go no higher then £3000 as they will not pay out more then 90% of a claim, I said come on this is a negotiation and said i would be happy to settle at £3150, he said i bet you would, then said ok and he will get the offer out in the post today and expect to recieve it in 2 or 3 days.... I make that about 94%
Seems HSBC are making a offer after 8 weeks, but if it goes to the court stage then they get their hard heads on and see it through for as long as they can.....
Will post on the success thread when monies safely in my account....0 -
I'm new to posting on the site, but get the mailout every week and used Martin's reclaiming guide to go after RBS who over six years have taken over £3500 in charges from my account.
The process initially started last September but didn't really commence until May 22nd this year when I asked for my charges back. A total of ten letters and seemingly nothing, still had debt collection agencies on my back.
I prepared my pack to go to the Financial Ombudsman and was ready to send this week. I decided to go with the FO following Martin's advice about the FO 100% success rate. However, I received a letter from RBS last night, sated 18th July so just within the two-month deadline I had given of the 19th July offering the full amount I claimed for - £3500.34!!!
I didn't claim for interest - I was going to in my claim to the FO but I wanted it dealt with as swiftly as possible. The letter of acceptance is going in the post!!
Keep going and if you can seek advice from the Citizens advice bureau, consumer credit counselling line and Trading Standards should you recieve threatening letters- I add and brought this up continously from RBS to show that I wasn't on my own but had been consulting other organisations as to what I was legally entitled too. I still have charges disputes to settle - Capitol One, Egg but should they prove unwilling to refund, I'll be using the Financial Ombudsman. It takes longer but I still have the option of court afterwards should they fail to reach a settlement!
Happy to answer any queries - thanks for all the help Martin, you're a star!!:jSlowly but surely getting rid of my debts
Bank reclaiming: £3500 RBS [achieved June 2007]
Capital One £96 [achieved Feb 08], Virgin MBNA £800 [achieved October 2008]0
