With so much support, I am ready to take on the GIANT! David beat Goliath and all he had was a sling. I have the law and you guys behind me. I have to, and, I will win this for my son who just last week was diagnosed with Multiple Sclerosis! Not the poor tale but just me needing to get justice for the people! And of course having all you guys backing me I can do it:grouphug:

You are right to get justice. Don't look at Barclays as the giant, look at them as a big company and the bigger they are the harder they fall.

Sorry to hear about your son, DO IT FOR HIM --- BIG TIME

MCOL will show it as acknowledged but you will also get a copy of the acknowledgment in the post which will probaly state that they "intend to defend all of claim". They did this with me and still paid up a week after. Its just a waiting game the Halifax like to play but they do pay up so hang on in there

thanks will do

• re Halifax - I'm very encouraged by your entry - i've been ignored all the way and my complaint time has lapsed (they've not asked what i want to complain about yet!) shall i phone them? i'm ready to do the court thingy on Friday 22nd June - for 2,677.39.

bank : Halifax
Amount Owed :£2806
Amount Paid :£2894
I had to issue them with a court summons before recieving £1157.06 deposited into my account. I decided to telephone them to see if this payment was from them.
Guess what it was, told them still £1768 short so court summons still stands unless we can reach an agreement now over the phone. Was told he can agree only £2500 now ,Which I declined, It was then he said Ill go and see if I can get clearance from my manager, Kept hanging on the phone for 2 mins, came back and said he can offer me now £2894 in full and final payment if I stop the court process, of which I duly accepted.
So the moral of the story is DONT GIVE IN TO THEM:j

Amount Claimed : £60
amount refunded £60
When? June 2007

I was charged £30 for going into the red for 24 hours by an amount of £101. They did not pre advise me of this. then I did get pre advice letter of a further £30 fee for being overdrawn, I thought this was strange as they'd already charged me this. Apparently the first charge was for paying items on my behalf whilst overdrawn, which is DISTINCT from the charge for BEING overdrawn. I was well miffed at this. I phoned up my branch, and I explained I was dissappointed at £60 of charges for such a pathetically small amount for a mere 24 hours. He explained these charges are "automatically imposed centrally in Belfast" I said to the branch manager, he had a choice. While he felt they could impose these charges, I felt aggrieved, given the "minority of the offence" and felt I could close my account, my husabnds account and a our joint account if needs be. So now the brnahc manager had a choice. :D He said he would refund it on this occasion and woudl stop the further £30 from being withdrawn. :T He further explained that he could not authorise such a reversal of fees again and I should ensure I dont go into red so as to keep free banking. Red rag to a bull.

PRIOR to this call, I was put through to a "customer care" advisor who claimed to have authority to overturn any unfair charges. he said he would not be doing this for me, yet the branch manager did, so clearly it pays to get to the individual branch manager as your business matters to them, MORE than it does to the centrally located customer care manager with no branch affiliation and therefore no appreciation of your business.

Claimed £614 (with interest)
Recieved £463

started back in april. This is what my sister has just been offered from HSBC and she is accepting. We both started our claim at the same time but i went down the court route because my interest comes to £600. We both sent the first and second letter demanding our money back with interest within 14 days. they replied to both of us saying that they're entitled to 8 weeks. (I only normally get about 10 days notice when they take my money from my account)

My sister gave them the 8 weeks, knowing they wouldn't pay her interest but also because reading other people's very helpful threads, stating that you do get a reasonable offer at the end of the 8 weeks. It really is up to yourself in which avenue you choose to go down.

They have aknowledged and defended my claim, i have sent my breakdown of charges (recalculated - more interest), a copy of a the claim (pdf print out from the net) and a covering letter stating:

I sent it via email:kateeaves@hsbc.com' and fax: 0121 455 2150

Dear Solicitor’s

I am writing in regards to the claim I have put into the small claims court against HSBC Bank plc. HSBC have put in a defence against my claim for £2769.65. As my claim is still accruing interest the new total amount as of 14/06/07 is £2792.09. This amount will continue to accrue interest until the amount is settled in full and includes my court fee of £120.00

I have enclosed a full detailed list of my charges and a copy of the original claim form for your information. Please do note that due to HSBC putting in a defence against my claim, that I will be taking this matter all the way to retrieve the full amount. Therefore, I will not be accepting partial offers of monies that are rightfully mine.

I look forward to your response on this matter,

Kind Regards

I am still awaiting their response and on a court date, I've noticed that D&G tend to settle when you've been allocated a court date

Hope this helps anyone with their HSBC claim, they are using delaying tactics to hold on to our money as long as possible. They do pay out. Let me know if this helps anyone or if you use my covering letter!!

Hopefully I'll be posting on here for myself soon.

Good luck everyone!!!!
