Reclaim Unfair Bank Charges article discussion Part II

hi i am cuurently trying to claim bank charges apx £1400 and have started court proceedings nat west have offered about £500 before i started proceedings now that i have n/west have offered £500 + court fee £120 and now i have a letter from their solicitor giving notice of intention to defend shoul i be worried or is this the norm

They are suing my son for his debt that has mainly accrued because of unfair charges and services:mad: We made a complaint on his behalf and got this lovely letter from the complaints dept stating they were looking into our complaint and then 8 days later we received a summons:mad: .
Everything is slow from Barclays (of course to slow things down). This makes them think that we will get fed up or scared and go away. NOT US! Their manner is definitely "bedside" and absdolutely agreeing with us with upmost sympathy that we should possibly have a complaint from such a caring bank. They were such a caring bank that they sent a lovely friendly leaflet and letter on how to complain and told us that they would get back to us, however this may take some time! They then, almost immediately issued a summons. I cannot find any thread where this has taken place before so believe it may be a new way of them "testing the water". Watch out for the Pyranhas (the fish that bite) lol.
We started all this in February and it is now June! You do however, get a faster response if you eMail them. However the contents of the eMail will be of little use as they say they cannot respond by eMail and will follow up by snailmail for security reasons. (Gives them thinking time).
Because you then have a dated record of your complaint etc at least you do have proof that you have done it!
Since the summons was issued, we have sent a defence and our court bundle is almost ready. We have also complained to the FSA (before the summons was issued) and they advised us to give the bank a last chance by telephoning them. We did this and that is what gave them time to summons us before we summonsed them.:money:

I can't see any successes on here for Bcard - I have a claim going thru with them. I have just rejected their offer of the difference between the £12 etc - not sure whether to go to the MCOL stage0 -

I hope in your defence that you highlighted the point that the majority of the debt was due to unfair charges. I also hope that in your defence that you have requested a full breakdown of their calculations of the charges.
THIS IS YOUR STRONGEST DEFENCE and a question Barclays Bank PLC will never answer. I see no reason why you should not include video evidence of a Barclays Bank Manger stating on BBC Whistleblower that the charges cost no more than £2-£2.50

I would suspect that the left hand of Barclays does not know what the right hand is doing here. All this is proving that the banks do not have good admin.
To take such action especially as you are questioning the validity of the charges creates a problem, not for you but Barclays Bank. They have firmly placed the noose around their neck and it's up to you to tweek it a bit, indeed tighten it. You see, if they continue with the summons, then you need to know all about their charges and calculations. You could end up in the fortunate position of being the first person in court with a bank where they have to prove and substantiate their charges.
If Barclays are stupid enough to allow this to happen, not only will it open the flood doors for everyone, it will cost ALL BANKS dearly and that includes Barclays Bank.
We all know that one day some little office in a bank will blow the whistle on themselves ... we are just waiting
In the meantime, consider yourself as the Pyranha. Remember that whilst this fish is small, it swims in shoals, just like us. 100 pyranhas could destroy a shark in seconds.
Have a little word in Barclays "shell like ear" and let them know the questions you are about to ask.
Do Barclays read these forums .... you betcha, so do all the banks every day.

Never lose sight of the one thing the banks are scared stiff of .... having to tell a court and the world how much their charges really cost.
