    We had exactly the same as that with a leaflet enclosed on "how to complain". 8 days later we received a summons from Barclays! Underhand or what! We have of course, submitted a defence and reported the bad practice to the FOS. We are now awaiting a court date

    just started my TSB claim today. i wonder if they'll skip the "lets go to court and then settle at the last minute" stage if i ring them and explain that i know the proceedure as have already claimed money back from halifax??

    i had a direct debit going out of my new bank account (co-op) and i put the money for it in the day before. how ever the dd came out that day and the co-op charged me for this. i phoned them and explain what had happened and they immediately refunded me the charge! i like internet banking!!

    could anyone advise me as to whether i could claim charges on the argos card i defaulted on a couple of years ago?? The account went to debt collectors eventually and i paid it fully. i'm assuming i can ring argos for details on the card, i don't have the statements or the card anymore.....

  • Hiya, previously was declined my charge request from the bank and contacted them via letter and phone that I was unhappy and they had 14 days to reply otherwise I will be starting court action....

    I have been away for a few days and have reviceved a letter stating as a "gesture of goodwill" they will refund me £370.00 (climing for £750) and that it is only a goodwill gesture and they are under no obligation to do so. it continues on stating that this is in 'full and final settlement of your complaint against the bank of scotland'.

    I do not know whether to refuse the offer and try for more or not... it looks as if most banks are now waiting for court action to begin and then they are filing a defence at the last hour...

    I know the final descion is mine... but I would like to hear what you all think first.....

    bankbandit..Don't worry, nationwide defence was entered by post the same day as me putting in my judgement by default. I think timing was;

    Fourteen days defence entered 5th May;

    Judgement by default entered by me 4th July, they defended by post;
    Then it the 'Letter' arrived the morning of 15th July.

    Hang on in there, keep telling yourself that you cannot loose, besides I actually got more than I asked for, then even refunded charges that they were trying to claim. They won't turn up at court anyway, all these are delay tatics to worry you, just put it at the back of your mind...

    Another way of putting if a little throwaway, is think of it as £120. I'm glad to see the back of them for good.

    I have 2 questions that I hope that soemone can help with.
    1. When I filed my MCOL I made a mistake and it was suspended. I spoke to their help line and they told me to create a new one, send them an email saying that MCOL*****1 replaces MCOL*****2 and they will refund the £80 for the first one. I had a reply saying that this would be submitted for refund but it was at the court managers discression, does anyone know what is the likelyhood of me getting my original £80 back and what is likely to be the time scale.
    2. I submitted my 2nd MCOL on the 18th and it seems to of gone through allright. The situation is that my account with Cap1 has been with a collection agency for some time, they have deducted their first offer from this account, which is fine by me, but if my claim is met in full including interest and charges it will be in excess of the balance due, will they clear the balance and forward me a cheque for the rest, I have heard many stories of banks paying claims into closed accounts and people having trouble accessing their funds, has anyone been in a similar situation and what was the outcome.

    I took them to court, they made the offer around 10 weeks before the court case. They also sent a letter first class dated the same day telling me how vigorously they intend on defending the case - a day later, the offer turned up!

    DON'T BE DISHEARTENED WITH LLOYDS - they aren't going to court every time... I'd resigned myself to the fact I needed to iron a suit, but had a nice surprise :)

    Please please please - don't be put off by Lloyds hard arm tactics. As Martin has mentioned several times on every radio/tv appearance that he makes, they case they won was on a very specific set of circumstances - they know this, and as such are still prepared to settle out of court. According to the person at their solicitors office, they are settling about three hundred claims each working day, and I was advised there will be a backlog in my bacs coming in to the account.

    You need to do this - don't do the stiff upper lip thing. Thanks to Lloyds, my debts will be paid and I'm off scuba diving for a week, and if it wasn't for this site, I wouldn't have been able to do either.

    There really is no goodwill involved, it's a bluffer.

    If you are convinced that the charges you are claiming are of the punative type .... stick out for the full amount.

    Ask them to provide you with a full breakdown and calculation as to how they arrive at the charges. Give them the statutory time to reply and advise them that you will go to court and ask the judge the same question.

    You'll get a full offer from them

    Amount reclaimed; 1040.07 inc interest and fees
    Amount Paid; 1040.07 in full
    Stage reached; Court proceedings, Lloyds TSB defended and disputed whole claim. I wrote (recorded delivery) three times to my own (ex bank it has to be said as I closed my account last year) branch and on last letter threatening Court action I RESUBMITTED NEWLY CALCULATED COSTS on the Interest calculator supplied by Martin on this site. All their delaying tactics cost them nearly £100 more in interest on the second calculations.
    Started MCOL claim 14 May - deemed serviced 19 May.
    They acknowledged at close of business on the 14th day - and then defended on close of business on the subsequent allowed last day... and I was just about prepared to go to the Local Court myself, when I got a letter from Sechiari Solicitors team in Brighton with a cheque for full settlement including my costs. A really good feeling - and thanks for making it all so simple to follow on the processes. Heartening to know we can win some days!
    Cheque in my hand 19 June 2007 - and now in our new account safe and sound! Confirmed to Northampton MCOL Court that settlement received in full.

    Thanks for this we have just received a letter from the same solicitors acting for Lloyds acknowledging the claim. Now the 28 day wait hope the result is the same as yours. Fingers crossed!!!!
