    any ideas
    had standard leter from mcol saying ack off service has been filed the defendent has 28 days from date off service to file a defence
    that time has gone as from today had no paperwork from mcol regarding this

    yet on mcol it said that defence you canot proceed any further your claim has been transferd this was dated on the 18th off may

    do i ring mcol to find out which court it has been transfered to to find out court date / or to see if the have put an defence in as time was up today
    and as i have 2 local courts which one ?

    my claim was issued on the 4th too, and they had till the 23rd of june to acknowledge, i have just revieved a letter to say halifax bank will defend, it is till the 25th of june because they dont count saturday or sunday in. hope that helps you...:A

    HI the thought had crossed my mind as well as i was told by barclays litigation dept that the offer i had was the one and only but they will
    setle up in full on or just befor the court date so yes they are wasting court time so y cant we send a foot note with the paper work saying i would like to instruct the court to strike out there defence as thet have told me that they are not going to turn up any way !!!!!!!!!!!!!!!!1

    That's very interesting oldandskint. That is really showing contempt to the court system. Do you have that in writing ?

    If yours does end in court, it would be worthwhile bringing this to the attention of the court.

    By the way, we or you cannot instruct the court, we can only ask, it's the Judge who does the instructing

    Thats great, well done .I am at the acknowledment stage with nationwide they have till the 9th july to defend. im trying to put together my court bundle . How long from mcol did they pay up as im getting a bit nevy now.They realy have put us through it and cant wait to get our mony back. Thanks you have given me hope as it does go on a bit and you get a bit down .

    As this is a "total decline" she can now, and in fact should as she is based in Scotland, use the Financial Ombudsman, have a read of the update in Martin's article and read the Reclaiming in Scotland thread.
    Thanks for your help again. She did phone them this morning and it would appear that letter was a delay tactic since they were already over their time limit. The fully intend sending her an offer and said to ignore that letter. How very ignorant and dishonest.
    It's about time those that can and indeed should, woke up and took heed of this sham. It is massive and yet the government is not intervening .... it's clear to me whose side their on!

    NO i was told this over the phone when i rang there litigation dept (barclays)
    you dont think they are going to put it in writing that would as you say leave them wide open for contempt off court, they think that they are the law off the land and sod everybody else (where is nick leason when you want him ) lol
