    I claimed £3700 from BARCLAYS, after a lot of messing around,got to the day i could ask for judgement,posted on line next day REJECTED they had acknowledged must have crossed some how!!
    Then i get letter offer£2400, was a bit cheeky , i said as gesture of goodwill i will accept £3300!!!!
    Phoned on the day they had to reply was told that was there final offer.
    Next day they have defended...so did i push it too far?
    WHAT next any advice please.

    Ps since i first worked out my charges they have charged me £300 more can i add on?
  • Natwest have acknowledged my claim on the 6th of June so 14 days is up tomorrow, do I enter judgement by default tomorrow night after midnight or am I supposed to wait 28 days from the 6th of June. I have received no paperwork from MCOL and can't seem to understand the 14 days to aknowledge/14 days to defend etc. Can anyone enlighten me?

    The claim is deemed served 5 days after the date of issue, if you receive an acknowledgement this 14 days then becomes 28 days from the date it was deemed served, if no defence is submitted within this time then you may request judgement by default,

    Advice needed if anyone can help.
    My sister has just rec'd a reply from BoS to her second letter.
    Total decline. No offer.
    Based in Scotland.
    Amount £1450
    She is going to try phoning tomorrow because they omitted to enclosed an advice leaflet.
    Can anyone advise next step?

  • I have had a claim for £4437 plus interest of £761, knocked back by HBOS, I now need to log a MCOL but am aware that my claim is over £5000 threshold for small claims, do I put the whole amount in and hope the small claims court take it?

    I'm a little confused as to my next step, I have read all the court guidance and lots of the experiences of other claimants but it seems to have made it more muddled, please help!!

    My claim against Natwest included the £28 as you have stated and they were paid. On occasions but not consistently, they would charge £30 per day for being in excess of overdraft limit (Max £90/month) these can also be reclaimed. If you have Advantage Gold Account you cannot claim the fee for this account (currently £12/month). This fee is sometimes added to the charges at end of month so should be deducted. Natwest are playing fair but won't pay the interest.

    The timescale with court or using the FO is pretty much the same. Have a read of the thread for the Alliance and Leicester, you'll find it linked in the Reclaim Help Thread and the thread Using the Financial Omubdsman and of course Martin's article.

    As this is a "total decline" she can now, and in fact should as she is based in Scotland, use the Financial Ombudsman, have a read of the update in Martin's article and read the Reclaiming in Scotland thread.

    Can any one help? What shall I do now? Claiming from NatWest - request letter with charges set out sent by recorded post and received 2nd April by Natwest. No reply so phoned and emailed (using address and phone number on this site) - told they had 40 days to reply (+ 16 for weekends and 4 for bank holidays) and so should receive offer by 1st June. Nothing came so phoned and emailed again. Told that offer letter (£2095 - what I claimed less the interest) had been "generated" on 22 May and to wait 10 working days. Still nothing so phoned again 19th June - told repeat letter had been sent 12th June and to wait 10 working days. Rang branch Bank Manager who said that he could do nothing as "all dealt with centrally" also rang Financial Ombudsman who said that as offer made (even though not received) they can't do anything. Apparently I have to sign the form that NatWest send - I can't just write and accept the offer which I have been told about over the phone. Can anyone advise on what to do next? and how long does NatWest take to put money into account after acceptance - straight into account or by cheque to address? I shall be closing my current account with them once I receive this money as I am so disgusted with their lack of admin am also hoping to persuade my four children to do so as well. Have already closed my business account with them. I understand that the branch manager has to explain why customers close accounts. Any suggestions will be greatly appreciated.

    I would like to claim back charges on 2 loan a/cs (see post 1353 page 68) Am I right in thinking that I can do this and do I follow the same steps as for banks? Any advice would be appreciated. Many thanks. I love this site!
