please help!!! im in process of calculating my charges, bank with natwest and there are many different charges i.e referal fee, unarranged borrowing fee,gtee card payment fee (all of these i think i can reclaim) but also there is a charge of 28 pound at the end of every month when i have had any of the above charges but if i havent accrued any charges that month then i dont get charged 28 pound. i have an overdraft is it related to this ? and can i reclaim these 28 pound charges too?0

my wife and i are trying to reclaim £2895 from the Alliance leicester we have gone as far as sending a letter asking them to pay us back this money,we have also sent a letter saying unless they pay we will go to court,
we recieved a letter today again saying their fees are acceptable
we are now not sure whether to go through the courts ombudsman advise appricieated

Just noticed on your post, that you claimed money from Studio cards, and received the full amount, so congratulations!
Just wondered if you could tell me how this worked with studio cards, as I used to have an acocunt with them, where I believe I was charged for fees for late payments etc, is this what you had been reclaiming from them? also how doe sit work with regards to how far back can you go with them, is it the same with the bank charges, 6 years? and also did you ask them to send statements of your account to you to check what you had been charged? would be grateful if you could let me know, as I could get some money back from them too, that would be great, look forward to hearing from you

I have eventually gone down the route of using the FOS in relation to all my claims, A & L being one of 5. Like you I have now secured a small victory but with Halifax(originally IF), claiming charges of £200, which they have agreed to repay but as far as interest goes only with 8% of this amount, not the amount accumulated using the moneysavingexpert interest calculator. As this is only a small amount I have agreed to them refunding £216:beer:, however with my other more substancial amounts, (£2000 +) do you think that I should hold out for the interest amounts as calculated by moneysaving expert system, is this what you did?

no i didnt ask for the interest, i just calculated the charges and asked for them, i was going to ask for the charges as a bartering tool (as in i would take a settlement without them if paid quickly) but i forgot to put them on!!
we were just glad of the cash offered and didnt bother about the interest, i didnt want to start a crusade with natwest - i just wanted to go to spain!!!
i think you have to weigh up your own cash circumstances and if you have time and energy go for all you can!
if you want it sorting quickly tho then take whatever you can get, it is cash you have waved goodbye to so any back is a bonus!!!0 -
Does anyone know in what circumstances the courts adjourn a case? If I were asked to provide further evidence to support my claim, I couldn't - after all the bank supplied me with the statements in the first place and I merely extracted the information I needed to produce a figure to claim. Surely, there is nothing more. I do intend to write to them asking them, as indicated to me above, to justify their charges, and hopefully their response, or otherwise, will arrive in time for my court date on the 16th July.
Do they have any laid down time for responding to such a question?

Claimed: £1040 (w/o interest)
First letter asking for refund 06/06/07
Received standard reply (looking into it) + leaflet 12/06/07
Alliance + Leicester
Claimed: £6299.47 (with interest) / £5309.50 (without int)
Received full 6 years statements (for standard £10) after a month.
Asked for charges back on 15/06/07 - no reply yet. I have told them "as a gesture of goodwill" I will accept the interest free figure if they respond within 14 days. I won't be holding my breath.
Is the court procedure any different because I am claiming over £5K from the A+L?
I am fairly looking forward to taking on the A+L because they are absolutely ruthless with their default charges. I was astounded when I added up all the charges - this quickly changed to anger.
This is a great site Martin. I am passing the word on. This must be a real kick in the nuts for the banks. LOL.

Natwest have acknowledged my claim on the 6th of June so 14 days is up tomorrow, do I enter judgement by default tomorrow night after midnight or am I supposed to wait 28 days from the 6th of June. I have received no paperwork from MCOL and can't seem to understand the 14 days to aknowledge/14 days to defend etc. Can anyone enlighten me?
