Reclaim Unfair Bank Charges article discussion Part II

hi guys,
had my second letter back from barclays just a second ago, this is what it says:
"i am sorry you are unhappy with the charges you ahve incurred. your comments are receiving attention and one of my team will contact you asap.
may i take this opportunity to explain that whilst we endeavour to respond within timescale outlined in your letter, we cannot guarantee that we will do so. etc etc. however we do aim to find a solution within 4 weeks. a full report will be sent to you within 8weeks."
so is this just the bank trying to fob me off or are they in their rights to take this long? if so how long do i give them? should i be expecting call from them with any kind of settlement offer? if so anyadvice on how to handle it?

They must follow your timescale, you do not follow their timescale.
Remind them of this and give them a date to respond by otherwise you will proceed without further notification to them
A business pal had a similar letter from another bank. He replied saying
"You can take as long as you want but by then the matter will have already gone to court"

im looking at reclaiming my natwest charges, as it was partly their fault in the first place when they didint pay my mortagage S/O one month so had to pay 2 in one month! since then my bank account is a mess, as the situation is snowballing month by month. all bills come out of this account every month, some arent getting paid coz of charges and so on so on!
ive entered into a repayment plan with natwest to pay £750 in 4 months! if i am to try and claim charges do i carry on with this? i have another account which from next month all wages bills etc will be used for.
anyone with any advice much needed....0 -

You do not make it clear the reason why they did not pay that month. If it was because the money was not available and they bounced the payments, you can claim back the £35 - £38 fees. If this is the case, Natwest are rolling these charges into a loan. You need to work out how much the penalty charges amount to and and request they are deducted from the loan.
If you had funds available to pay that month and Natwest cocked up, then the onus is on them. That would be a case of mal-practiceThe Winner Takes it All0 -
Congratulations AJ can i ask at what date did you file mcol and when did they acknowledge, also did they pay interest, not sure if you asked for it. My claim was issued 4th june, deemed served on 9th june, not heard anything yet, so they have until 23rd to either acknowledge or defend or i can ask for judgement, i think so anyway. As the 23rd is saturday, can you request judgement online or do you have to wait until monday.

the funds were in the account and despite the fact they had been paying it by the same means since aug 06, they had the standing order account number wrong! by the time i had sorted this out some money had been withdrawn from the account not a lot though, and it meant two mortgage payemtns were taken from the same wage packet! because of the the situation is not getting resolved as they are taking charges each month and the whole thing is snowballing out of control, even though i am on a repayment plan with them can do i still go ahead and carry on paying them if i try and reclaim my charges?0

Just wanted to check, but got my bank statements back do I now send the letter to my bank as in my branch, or do i send it to head office!!
Had a look but cant see it saying that anywhere!

Clearly the judges are getting more and more annoyed due to the "no shows" of banks in court.
As this is wasting time, does anyone here know if at the end of your claim you can put a foot note to the Judge such as
"As Banks rarely present themselves in such cases, could I ask the court to contact the bank requesting their intention to appear. If they fail to reply to the court within a set period of time, any defence they may have should be struck out. This would save the court wasting further time"
HI the thought had crossed my mind as well as i was told by barclays litigation dept that the offer i had was the one and only but they will
setle up in full on or just befor the court date so yes they are wasting court time so y cant we send a foot note with the paper work saying i would like to instruct the court to strike out there defence as thet have told me that they are not going to turn up any way !!!!!!!!!!!!!!!!1:rolleyes: ITS A FAR BETER THING I DO NOW THAN I HAVE EVER DONE BEFORE

If what you say is correct, then it's about time you had a serious chat with your branch manager.
If it was their fault, penalty charges should not have been added. These charges as you say will snowball so ....... demand ALL the penalty charges back plus the interest accrued and DEMAND compensation for their abuse on your account. Do not be fobbed off with excuses about their charges. It is your right to know how they are calculated.
If the Natwest will not play ball, report them the FOB and if need be the FSAThe Winner Takes it All0 -
