Can any one help? What shall I do now? Claiming from NatWest - request letter with charges set out sent by recorded post and received 2nd April by Natwest. No reply so phoned and emailed (using address and phone number on this site) - told they had 40 days to reply (+ 16 for weekends and 4 for bank holidays) and so should receive offer by 1st June. Nothing came so phoned and emailed again. Told that offer letter (£2095 - what I claimed less the interest) had been "generated" on 22 May and to wait 10 working days. Still nothing so phoned again 19th June - told repeat letter had been sent 12th June and to wait 10 working days. Rang branch Bank Manager who said that he could do nothing as "all dealt with centrally" also rang Financial Ombudsman who said that as offer made (even though not received) they can't do anything. Apparently I have to sign the form that NatWest send - I can't just write and accept the offer which I have been told about over the phone. Can anyone advise on what to do next? and how long does NatWest take to put money into account after acceptance - straight into account or by cheque to address? I shall be closing my current account with them once I receive this money as I am so disgusted with their lack of admin am also hoping to persuade my four children to do so as well. Have already closed my business account with them. I understand that the branch manager has to explain why customers close accounts. Any suggestions will be greatly appreciated.

And give them the information above.
Even though you are writing to Scotland, if you live in England, you are covered by English law.
Once this has been resolved for you, closing your account is the best thing to do. I know of many people who have already moved from Natwest because after reading these forums the bank show themselves as very poor.
As Natwest advertising on TV say "There is another way" , At least they hit button correctly here !!!!!The Winner Takes it All0 -
Clearly the judges are getting more and more annoyed due to the "no shows" of banks in court.
As this is wasting time, does anyone here know if at the end of your claim you can put a foot note to the Judge such as
"As Banks rarely present themselves in such cases, could I ask the court to contact the bank requesting their intention to appear. If they fail to reply to the court within a set period of time, any defence they may have should be struck out. This would save the court wasting further time"The Winner Takes it All0 -
Hi, Does anyone know generally how long it tlkes to receive copy of the defence/court date etc..I had my claim against HSBC rejected as they filed the defence on the day I asked for judgement! This was the 5th of June and I haven't yet heard anything back from the court. Any help appreciated please. I am getting quite nervous now!!!0

I sent the template letter to Barclays with breakdown of claim, including interest, and requesting a response within 14 days. They replied just within that timescale but the letter says they are looking into it and will be in touch within 8 weeks. Sounds like they're just stalling me. Do I have to wait or should I write telling them I'm not prepared to wait that long and state a time limit that I would like it settled within. Advice would be very much appreciated. Great site by the way!0

Another stalling act by Barclays.
You gave them 14 days to respond, they do not have any opition, just tell them that you will proceed to court without further notice.
Also tell them you will require a full and detailed explanation as to the calculation of the charges to which you will ask the court the same.
It never ceases to amaze me that once we thought that banks were the pillar of society but forums like these are rather showing that we are dealing with "back street organisations" who treat their customers with the utmost contemptThe Winner Takes it All0 -

Success! On Monday I received payment direct into my account of £2,132 from Lloyds TSB!!! Following Martin's advice-- Asked for copies of last 6 years bank charges = £10
- Calculated what was owed & sent first letter = 1st class stamp
- Lloyds TSB replied basically saying I did not have a case and had agreed to these charges
- Was not put off - sent second letter claiming explaining that if there was no refund I would take small calims court proceedeings within 14 days = 1 x 1st class stamp
- No reply - Went onto money claim site and started proceedings = £120 fee
- Lloyds TSB contested therfore hearing set for 4th July
- Monday 18th June payment received! (included refund of court fee)

No it was because of the timing. I put in my claim for judgement by default on the 29th day & they put in their defence on the 28th day but on contacting the court they said that it takes 24-48 hrs before it shows up on mcol!0 -

As this was clearly not your fault but more so the court inputting data on their system, why don't you write to the court explaining that had you known a defence had been placed, you have proceeded by attenting court.
Ask them what can they do about it.
THIS MUST BE WARNING TO EVERYONE.
The banks may have seen a loophole in the court system well knowing that a defence filed at the last minute does not go on the system immediately. Therefore, those "itching" to request a default on the last day should wait a little longer (24-48 hours) and then check the MCOL.
Because the banks know they must file the defence by a certain time, they will still have no option but to do just that. HOWEVER, what they do not know is you are waiting that extra time. As they say "gently gently catch a monkey"
Who is it that says "we give you extra" ????
