The situation is that my account with Cap1 has been with a collection agency for some time, they have deducted their first offer from this account, which is fine by me, but if my claim is met in full including interest and charges it will be in excess of the balance due, will they clear the balance and forward me a cheque for the rest, I have heard many stories of banks paying claims into closed accounts and people having trouble accessing their funds, has anyone been in a similar situation and what was the outcome.

    Was wondering if anyone can help...... I have sent letters off to MBNA, Barclaycard, GE Money & Barclays to ask for statements. MBNA sent me statements within 1 week, Barclaycard sent me statements up to 2003 and are sending the rest.
    However, GE Money sent me a letter detailing my charges but no copy statements, it just sent me a letter with a few dates a description and the amount. Is this correct or should they of sent me copy statements? Also Barclays recieved their letter requesting copy statements (checked on Royal Mail as I sent all as recorded delivery) but I have heard nothing. No acknowledgement or anything. What should I do now??!!

    :mad: I am in confussion, been following site for a while, wrote letter 5 and posted 20.05.07 (lloyds TSB), delayed a little cos of Berwick case, but recent successes have spurred me on again. I have just submitted my claim using mcol, pushed button then realised that account no is nowhere on the claim. I used Martins template letter 7 and changed it etc where indicated but now realise that the account number might have needed to be inserted in the text. Has anyone else submitted the court form with no account number? It would be a costly mistake if thrown out for such an error. Now I am worried

    I would ring the MCOL help lilne and get advise from them, you may not have to cancel in this instance.

    My mistake was I accidently put Crap1 as the defendant and the claimant doohhhhhhhhhhhhhhhhhh:rotfl:

    I claimed against Nationwide and they had until 15th June to put in a defence. I too had been gathering evidence in the event that they actually went all the way. I was claiming on a closed a/c I had with my ex husband and I was watching MCOL and my a/c every half hour. My ex phoned me 3 hours before deadline and said they had sent a cheque made payable to both of us. They paid the full amount including interest and court fees amounting to just over £3200. The letter said they expected us to manage our a/c according to the t&c's in future or if not that we may need to consider moving banks!
    MCOL still only says "acknowleged" at present and I have no intention of calling off the dogs until the cheques are cleared.....Nationwide cheques in a Nationwide a/c still take 5 working days to clear!!!!

    Hope this helps. Good luck with your claim. Nationwide were not at all understanding with us when we needed their help most either. It 's nice to get your own back though!!;) I'm sure they will pay you too so keep smiling!

    Yes you can. I did and won.(see post 1436 above) Just follow the same instructions from Martin.

    Everything is slow from Barclays (of course to slow things down). This makes them think that we will get fed up or scared and go away. NOT US!     Because you then have a dated record of your complaint etc at least you do have proof that you have done it!
    Since the summons was issued, we have sent a defence and our court bundle is almost ready. We have also complained to the FSA (before the summons was issued) and they advised us to give the bank a last chance by telephoning them. We did this and that is what gave them time to summons us before we summonsed them.:money:
    Watch this space.

    thanks for the info, i thought barclays couldn't sink any lower after what the did to me but i was wrong they are now just sewer rats, and that might be an insult to the rats, because rats a very clean animals ,thats more than what i can say about barclays ,and yes there is a thread on hear somewere where some one was counterclaimed i will endever to try and find it but if any body else comes up with somthing fine ,i am right behind you on this one all the way keep me informed, as i have just filed an harassment charge against barclays WATCH THIS SPACE , GOOD LUCK BABE OAS (DAVE )

  • After following the guidelines laid down on this site, Plus making a few polite telephone calls to Barclays Customer Services, they have offered me £1200 as full and final settlement the day before I was about to register my claim with the courts for £1600 plus intrest. Bit of a dilema.. should I accept knowing that they owe me more or should I take them to court for the full amount ?
    How much longer will it go on if I opt to continue my action ?

    It is after all £1200 that I thought was gone forever.
  • RBS have offerered to pay all of my initial claim minus the interest element. Has anyone been successful in claiming interest off RBS?
