Bit of a dilema.. should I accept knowing that they owe me more or should I take them to court for the full amount ?
How much longer will it go on if I opt to continue my action ?
It is after all £1200 that I thought was gone forever.
DON'T GIVE UP, you claimed for £1600 so go for it. It's just another try on from Barclays. Just tell them that you will only accept as full and final settlement the amount you will claim against them in court.
Don't forget to ask them how they calculate the charges as you require a full breakdown. You will ask the court the same question.
You'll get your full amountThe Winner Takes it All0 -
As my court date approaches, could I just ask for guidance on what the court "bundle" is . What I have sent to Barclays litigation and the Court are :
An excel schedule produced by me from my statements, stating individual dates, amounts and reasons for charge.
The interest calculator copy
All letters sent to, and received back from, Barclays
I was not asked to complete the questionaire.
I am contemplating downloading the Barclays "admission" video onto my laptop to take with me, but not sure about this one. What does anyone think?
Is there anything I am missing please?I really don't want to be adjourned as I am going on holiday on the Saturday following my court hearing, and it would be such a loan off my mind if it were over.
Many thanks.0 -

Your bundle is OK. There is no harm using the Barclays admission video if the Judge will allow it.
HOWEVER, chances are that you will not have to use your bundle or the video as Barclays will not turn up. Silly if they do because you will ask them for a full breakdown and calculation of their charges. Don't think even Barclays are ready to answer that question. The Winner Takes it All0 -
Cyberman - thanks for your advice I've put a letter to Barclays today to the effect that I'm giving them 14 days to respond, failing that court action will be taken to reclaim the charges without further notice. Fingers crossed! I feel out of my depth but I'm determined to go ahead with it. Knowing I have help and advice available at my fingertips through this site give me the confidence. Thanks again.0

I have claimed against Barclays and was given a Court date in August. As a
suggestion, on their Defence form you will see a name and a telephone number of a Barclays Solicitor. Ring that number, the answer I had was - we
do intend settling with you the full amount you are claiming, we try to settle three weeks before the Court date. This worked for me, I did the same with
my Barclaycard claim and both were settled and paid to me within fourteen
days of my call to the Litigation & Disputes office. 0207 116 47530 -
Hi does anyone have any advice they can offer? FINALLY got my six years worth of statemants from HSBC-they waived the £10 fee as a "goodwill geature" ( where was their goodwill when they took £3000+ from my account eh?
I sent off a full list of claims & the standard letter saying that I wanted to hear back from them in 14 days. I have now got a reply saying that thay are looking into it and will get back to me but don't say when!!! Should I press on and send the threat of court action after 14 days any way??? Am new to all this so please excuse my ignorance!!!0 -
Have just recieved a letter of the court with the transfer of proceedings to my local court, with it was lloydsTsb defence. Looking through the threads l see it is the standard response, l am busy getting my court bundle ready i.e my account of the charges from lloyds , a statement of each charge l have pain stakingly gone through plus all letters to and from lloyds (not many from l should add) can`t think of anything else. Would it be worth going to the bank and picking up a terms and condition leaflet as dont have one from when l opened the account(who does).
Plus has anyone called their solicitors Sechiari Clark and Mitchell to see if they will settle before the court hearing would love to know thans
Also recieved an offer from Barclaycard after first letter, but have written back declining and stating l would settle for a slightly smaller amount than what l`ve asked for, anyone else done the same thing0 -

Apologies if this has been debated before. I wrote twice to Lloyds TSB in February and March seeking details of charges/statements. Each time I had a letter back saying they will need more time. Finally in May I complained to the Information Commissioner. A letter was sent to Lloyds by them at the end of May (so I am told). Is there anything else I can do or will the Bank just continue to ignore me?0
