Ok then, I thought all was going well.....

I went through MCOL, the bank (in my case Alliance and Leicester) did not acknowledge the claim and I won through default. I then requested a warrant be issued which was approved and sent off to the bailiffs for action.

Today I checked MCOL to see the status of the warrant to find that is said "UNFULFILLED" and a brief explanation that

"The Bailiff has been unable to recover the amount shown on the warrant. You are unable to take any further action online on this warrant."

How can this be when I gave the address of a bank!? Surely an international bank could afford £2790 !?

I am now slightly confused as to what I can do next? Can anyone help me?

Rather odd isn't it like you say, I think it's perhaps best to give MCOL a ring in the morning and ask their advice to enlighten you on it and what they advice you can do next,

I have now received the notice of transfer to the Newport Court, I rang them to accertain when the is the best time for me to send in my response to the defence from Barclays, with 'the bundle' and was told that the case was to be sent to Cardiff Court as this is the procedure with these bank claims. so Cardiff will send the hearing date, but I will take my 'bundle' to Newport as they still have the file. It is ordered that the allocation questionaire be dispensed with........

Hiya Agnes - have had the same performance with Newport & found out it was being transferred to Cardiff. Then I had a court date sent through for 14th August. You sound organised in getting your stuff together for court. We should give each other moral support as we're 'neighbours'!

I first found out about claiming £ back from banks as I got a phone call offering svcs and pd £40 for a pack with all forms etc in.
No, not bright and yes, I AM new to this site!
The co. is called 8888888888888 and they also offer a "platinum service"- for a cut of 20% of the charges reclaimed.
my query is has anyone used these guys before, did they work, did you trust them with your bank details and with any compensation to be paid out (as it seems to go via them first?!)
I would do the claim myself but we are both useless when it comes to paperwork and stuff sits around waiting for someone else to deaL with!
At least with this we'd have potentially 80% of something rather than 100% of nothing at this rate!!!
    Look forward to your opinions.;)
    Thanks!

Hi,if i were you i wouldn't even consider using one of these companies, the only people thy're helping is themselves to your money.Try having alook at some of the posts in the thread for your bank, you'll probably find these really helpful(i did,and have succesfully reclaimed all charges from my bank). You can print off the template letters from this fantastic site, the advice from the board guides is excellent, and if you have a question or just need reassurance there are plenty of people who are more than happy to help on here.Just consider if you were claiming £1000 back then they would get £200 of it,and the more you're reclaiming the more they would get, surely that money is better in your pocket than theirs. GOODLUCK.

    hi guys,

hope someone can help me!!! I recieved my statements from barclays today, but am confused on what i can reclaim...i have looked on the "what you can and cant reclaim help thread" but am still unsure. On my statements it shows alot of bonced cheques (i know i can reclaim these), but directly under each bounced cheque there is an interest fee. some are small (£1.80) and some are more (£16.88) are any of these reclaimable?

Also it may be worth mentioning that my account was over the agreed overdraft limit? Does this have any affect on it?

    Thanks in advance.

You cant claim contractual interest...you can claim the statutory interest which relates to the 8% daily rate, you can claim compound interest, but this isnt in your best interest and is difficult to calculate.

  • Hi everyone! Is it possible to cite your examples of pay outs in court? Claiming from Natwest and Barclays and looks like court might happen (aiieee!) but wondered if I could use other success stories to back up our claims? Along the old 'discrimination' route?
    Thanks!
  • hi there,
Glad to hear that you have claimed your charges back! I am in the process of step 5 (court ) - could you tell me what process you got to until they paid up?
    Cheers
  • did you have to chase they up after sending letter threatening to take them to court?>

Due to be in Leeds Mercantile Court 28th June. Have received letter from Banks Solicitor which as one would expect drones on a bit about how none of this is the banks fault as well as telling me that despite all this the bank would like to pay me the whole of my initial claim plus interest, plus court charges as long as I DO NOT show the letter to anyone else, keep the agreement to myself, it's full and final settlement and I send them a copy of the letter I send to the court to end the case. AND |finally that I do all this by June 16th.

Should I sign and think "Ta Very Much I win" or should I be sending a letter saying, "well I thank you for the money, you have 3 days to pay it into my account (I would send my letter registered post) or I will see you in Court and I will claim the interest that has accrued in the time you have been mucking about." Should I really allow them to set conditions? Would I not be within my rights to say,,,"I wil accept your payment and end the case in full and final settlement but I will discuss this with whoever I see fit"?
You're being offered everything you asked for! Take the money, no need to go to court. Just keep schtum and not show the letter to anyone.
