    Hi, hope someone out there can give me some advice!!!! Today received letter from RBS saying that they do not agree with the basis of my complaint and believe that the charges they levy are fair, reasonable and transparent. However after reveiwing my case and as a gesture of goodwill and without admission of liability or error are prepared to pay me the full amount of £940 which was the sum of my claim. Yippeee, however they say they are going to pay the money directly in to my account, but as my account was overdrawn for so long they passed the debt to a debt company. My question is do I have the right to demand that this sum of money be paid to my in the form of a cheque or paid into another account, please help, thanks, Gaylexx.

    Let the court claim progess as it was - write back to Lloyds saying that you accept the £750 as part refund only and without prejudice and that you will be pursuing them for the remainder. Template letters are available on here, I believe and over at CAG, although as long as you include the phrases underlined, that's basically enough.

    You may want to add an amendment to your Particulars of Claim but I am not experienced enough to advise you on this point and whethet or njot it's completely neccessary, but there are many people here, who will know.

    Hiya all i have a mcol against abbey they have put a defence in and have got until 5 july to respond to it but i had made a mistake on the first claim with interest so i sent off new forms to mcol courts but they said i forgot to fill in about the charges on my n224 form so sent them back with £35fee ahhhh.So before i resend it all off again i have contacted a Inga Kirkman who i think is a chief negotiator with abbey saying if they make me a offer of £1500 out of a claim of £1570.99 i would not carry on with court claim giving them couple days to answer if not forms off again to re-issue new court proceedings let you know what happens.

    Have been trying to get charges of approx £600 back from Nat West Credit Card. Twice now I have received a letter indicating their charges are fair - whatever - but offering to reimburse me the difference between the £12 charge which they are currently charging and what I was charged up to the point of the new £12 charge. They calculate this to be £110, but even on my own calculations I make it £130 ish without interest, and they say it includes interest etc - where do they get their figures from! Anyway, the last letter they say was their FINAL letter and if I'm not happy contact the Ombudsman.

    Can I do this even though they have made an offer however ridiculous. When they sent me the first letter with the offer of £110, I wrote back and said basically NO but I will accept £300 which splits the difference. Didn't want to be too greedy, but then the second letter comes yesterday offering the same amount.

    Any advice folks!
  • can anyone help...ive taken abbey to court for £1120, and then today they sent me their defence and offered me a goodwill gesture of £730. should i ring them and say i want the full amount? is it likely they will go to court now that they have defended ?as i dont really want to! i want to tell them that the minumum amount i will take is £1000.
    please help.....

    You can put a complaint to the FO as soon as the company state that it is their final offer. Sometimes this alone stirs the company up. I had the same with Naturally close (part of JD Williams), they offered £1 as a refund of £322. When they said it was there last offer.I informed them a formal complaint had now been lodged with the FO, and within 2 weeks, I got an offer from their solicitors offering to clear the account of £254. However, I have written telling them considering their offer before I cancel the FO claim (let them see what its like)!!

    Hi all,new to the forum,but just come on here to make an enquiry. I have sent letters off to both the Abbey & Halifax to claim back £950(although about £600 of this is from before the six years you can claim) & £350. Been knocked back by both. I am in the process of taking them both to court.
    However,i checked my Abbey statement today & £202.85 has been credited to my account & i haven't a clue where from! Has anyone else on here made a claim against the Abbey & if so can you tell me the reference word used on your statement when they credited your account.

    in the second letter i have to send do i send a photocopie of all my charges or just the copy from the caculator on this web site ?

  • just send photocopy thats what i did as long as it is legible and states the amount of charges and interest, it dont matter how you send it

    my bank has paid up, how do i stop the court proceedings, i log into money claims website and it has the options but im not sure
