Hi - Can someone please answer some Q's for me ...:o

I am putting together my Court bundle & have been asked for "a statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise" ?????????? What does that mean in English (lol) & also, I am follwing the CAG suggestion for the Court Bundle & it says to include 'latest schedule of charges' - by this am I to take it that it means all further charges since filing MCOL?

Thanks so much in advance. :p

Havnt been on site for couple of days and just catching up - assume you will have this by now - if not reply to this post as I got bril statement of evidence from someone on the CAG site - JayneG
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

Hi, Halifax have said that they will re-investigate my charges, do I have to wait for the outcome, or can I go straight to the FOS?

Hi I used the registered address Trinity Rd ( I think ) but you'll see it on the bottom of any correspondence you have from them. All in all once I'd filed it took about a month and the money was there a couple of days later.
best of luck! I don't see that using your local branch would be held against you and I believe people have done that before but you might want to pm one of the experts.

i'm in the process of claiming from Natwest so i'm waiting for the outcome before i start on Abbey but just had to post this! Had my latest statement and i had a DD returned last month charge of £35 which i knew about, also TWO lots of interest due to be debited, so i queried this tonightand told the lady i was already struggling so she offered to postpone one charge until july, when she asked if she could help with anything else, i got brave and asked her to refund the direct debit fee as well!!! in for penny in for pound i told her, and she said yes!!! Can't wait for when i send my claim in for the lot!

Hi - Am currently in the middle of claiming 3 different accounts with Barclays & Lloyds....
All been transferred to my local court.
Been sent the Allocation Questionaires to be filled in - BUT they have asked to send the Questionaires back with £100 cheque attached to each one!

I shall do - but NO WHERE have I read that I was to do this - as I had already paid over £ 300 in Online Claim Fees...

ANyone else had to do this?

    Hi Sarah

It is not immediately transparent when reading through everything, especially if like me it you reach a point of reading it but not taking it in. Anyway the basic answer to your question is Yes you will have to pay these charges.

It is there in black & white in the help threads, however there are certain circumstances where the fees are waived but this is dependant on your financial situation. I would advise you to have a look at the HMCS website and see if you can qualify. Also, as I understand you add the amount to each part of your claim, so in effect the bank will end up paying it for you as they do with the amount you pay through MCOL when you submit the claim.

Hope this is of some use to you and good luck!

I first found out about claiming £ back from banks as I got a phone call offering svcs and pd £40 for a pack with all forms etc in.
No, not bright and yes, I AM new to this site!
The co. is called ******** and they also offer a "platinum service"- for a cut of 20% of the charges reclaimed.
my query is has anyone used these guys before, did they work, did you trust them with your bank details and with any compensation to be paid out (as it seems to go via them first?!)
I would do the claim myself but we are both useless when it comes to paperwork and stuff sits around waiting for someone else to deaL with!
At least with this we'd have potentially 80% of something rather than 100% of nothing at this rate!!!
    Look forward to your opinions.;)
    Thanks!
    x

I wouldnt trust these componies,at the end of the day how did they get your phone number in the first place???iv had a few call me on my mobile and the people on the other side couldnt even speak english properly!
its so easy to do it your self, just use martins template letters, which are ready to download for you already on the "reclaim bank charges" page!
why take 80% when you can have 100%;) :D

Due to be in Leeds Mercantile Court 28th June. Have received letter from Banks Solicitor which as one would expect drones on a bit about how none of this is the banks fault as well as telling me that despite all this the bank would like to pay me the whole of my initial claim plus interest, plus court charges as long as I DO NOT show the letter to anyone else, keep the agreement to myself, it's full and final settlement and I send them a copy of the letter I send to the court to end the case. AND |finally that I do all this by June 16th.

Should I sign and think "Ta Very Much I win" or should I be sending a letter saying, "well I thank you for the money, you have 3 days to pay it into my account (I would send my letter registered post) or I will see you in Court and I will claim the interest that has accrued in the time you have been mucking about." Should I really allow them to set conditions? Would I not be within my rights to say,,,"I wil accept your payment and end the case in full and final settlement but I will discuss this with whoever I see fit"?
