    I have now received the notice of transfer to the Newport Court, I rang them to accertain when the is the best time for me to send in my response to the defence from Barclays, with 'the bundle' and was told that the case was to be sent to Cardiff Court as this is the procedure with these bank claims. so Cardiff will send the hearing date, but I will take my 'bundle' to Newport as they still have the file. It is ordered that the allocation questionaire be dispensed with........ :cool:

    You cannot be forced to deal with a collection agency and they must not harass you. If you do get a letter from a collection agency, write back and request why they are contacting you as you are claiming money from the RBS. IT IS THE SAME OLD STORY .... you request from the bank a full breakdown of the amounts you are claiming. At the same time WARN The Royal Bank of Scotland that until they provide such information, you will consider any outside intervention as harassment

    An eye should be kept on Barclays in a move on there credit card front they are going to transfer a lot of accounts over to Raphaels Bank and serviceing of accounts will be given to CompuCredit if it's the same company as operate in the US they stick large fees onto accounts if payments are late and give no mercy.

    If they behave badly and add on charges more than dictated by the OFT, guess a court will show no mercy to Compucredit

    This thread is huge I have done my best to search for the answer but I cant find it :(
    Cancharges be reclaimed if the account is already closed?
    Its my sons account and its been closed about 6 Months with TSB

    8 wks were up Friday, with more fobbing off! Anyway after a few phone calls & e mails, stating that this was unnacceptable, & that if i didn't hear anything by today that i would take them to court & i would get interest on top, and i would complain to the FO. After FINALLY getting thru they said that an offer letter has been sent out today So success in part, depends on the offer, I'm not going to go below £8k. If the offer is less, does anyone know if I can "haggle" over the phone?

    Thanks Martin and everyone here, cos if i get this it pays off all my debts with some to spare, & I have NEVER been in that position!!

    Hi

    Can anyone help? I am at the Court stage using MCOL, it was served to the Halifax on the 16th May 2007, then acknowledged on the 21st May 07 saying they plan to defend it. If I am correct, they have until Wed 13th June (28 days from when it was served) to issue their defence. I have not heard anything from them and they have not paid back anything. If they do not defend and they have not paid me my money back, do I just enter a judgment via MCOL on wed 13th June? Has anyone done this and if so how long did it take for them to pay up? Any information on this would be greatly appreciated. thank you:confused:

    I am in the same position as you, my claim was aknowledged on the 22nd of may and they have until the 18th of june to file a defence. but I know of many other cases where they have settled much sooner.

    So I am quiet annoyed that I am getting the cold shoulder:mad:

    You can haggle over the phone, by email, letter and if you wish, by carrier pigeon :p

    The ball is in your court. Theyre showing willing to settle prior to any further recovery action so its up to you what you will accept. :)
