you will shortley recieve a letter from the courts stating your banks defence ,you just have to sit back and wait for the court now im afraid
they will make contact with you regardin your court dates/tranfers etc0 -
Correct me if I am wrong but when the bank 'acknowledged ' my claim it was given 28 days to submit a defence, and even then because the 28th day fell on a Saturday they were given til midnight on the following Monday. they filed the defence at the last minute literally about 11pm preparing for court!!!

I am putting together my Court bundle & have been asked for "a statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise" ?????????? What does that mean in English (lol) & also, I am follwing the CAG suggestion for the Court Bundle & it says to include 'latest schedule of charges' - by this am I to take it that it means all further charges since filing MCOL?

Would it be best to:
1. wait until it is in the black
2. Has anyone used or heard of Cobley Johnson Partners or Conkers. (they are basically companies that get the money back for you and take a %, max 50 pounds i think - reduces the hassle somewhat)

I've finally got a court date for my claim against First Direct, but I am a little confused as to it's wording.
It says:
Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.
IT IS ORDERED THAT
1. Directions will be given in this case by the designated Civil Judge on the 14th August 2007 at 10.30am at Cardiff Civil Justice Centre blah, blah
2. The parties may appear in person or make written representations as to how the case should proceed provided a copy of the representations is sent to the court and the other side at least 7 working days prior to the hearing.
Does this mean that the judge is ordering First Direct and I to come to some sort of agreement before the court date ?
Can anyone advise ? This is not what I was expecting from the court !!Reclaims in progress:

my current account is well into its overdraft at the moment and i am in the process of claiming from Abbey, so i would say go for it.
never heard of that company but from what i have heard of other companies like that, they usually charge about 20% +.0 -
I have been trying to claim back charges on an old nationwide account. The account is in default beacause of these charges, does this mean the account is closed? I havent used the account in well over a year and do not have a card etc for the account.
I issued a claim online against nationwide for the total of 281.00 plus the 30.00 court fees. The defended the claim on the last day and have stated in their defence that they have refunded me the charges of 287.49 (257.49 charges plus 30.00 court costs). This is not the full amount they owe me and also they have apparently put in in my old account, so I have no way of checking to see whether they have put it in there. And due to the fact that it is not the full amount owed I have not been paid back my court fees basically which I am not happy with.
Does anyone know what I should do now? Do I defend their defence and continue the court proceedings? Or do I contact nationwide? And if I do how do I go about it?
