  • on monday i received an offer from natwest which i signed that id accept then today i received about a 20 page list of questions from their solicitors cobbetts what should i do any advice appreciated?

    Bank : HALIFAX
    Claimed : £2294.18
    Received : £2294.18 +court fees

    Followed advice on site through to court stage, Halifax entered defence against the claim, disputing the full amount. I then received a letter yesterday saying they wanted to settle in full for 'commercial' reasons. Money was in my account this morning. Job done... :j

    Well done ! ! How long into the 28 days did you recieve a letter and funds? I have entered a claim via MCOL, Halifax have said they will defend, their 28 days from date served is up on the 13th June 07. Just playing the waiting game now.....fingers crossed.:question:

    Hello,

    I issued a MCOL claim against Barclays for £2280 on 21st May, deemed served on 25th May.

    14 day period due to end tomorrow (9th June).

    My query is - can I proceed with the next stage of action online immediately after midnight tonight (supposing they still havent aknowledged or defended my claim)? Or do I have to wait until 14 days to the minute I made the claim (12 noon)?

    Very keen to resolve this!

    My 8 weeks is up today! Just phoned, as I have done every day this week, everyday they have told me it's being passed on to their Supervisors, nothing on the system at the moment, today we apologise for the wait, blah blah blah This is so maddening, didn't give me more than 8 weeks before they took my money!! I did ask if I could speak to a supervisor about this, but said no as they were working on all claims. Anyone know of a different number to call or can i speak to someone about this? I think it's MCOL here I come! :mad: :mad: :mad:

  • I have recently started a claim with Natwest and on the 14 day deadline they replied back to say that they will respond to my letter in 6-7 weeks once they have looked at the file. Is this the norm? It sounds a little unreasonable, can anyone give me some advice?

    I have to admit that I am getting very downhearted and frustrated with First Direct and this whole procedure. The first letter was sent to them 15th February and has gone all the way down to MCOL, then Swansea County Court and now finally Cardiff County Court. Still don't have a court date and neither do I even know who the judge is.

    I see so many success posts on the success thread regarding wins against First Direct, many after only one or two letters and no court action. Seems to me to be a neverending saga.

    Each day I wait for the post to arrive in the vain hope that a settlement offer will be present and each day I am disappointed. These stalling tactics, plus the fact that the courts can't keep up are frustrating to say the least. When they want my money, they just take it. But we have to jump through hoops to get it all back.

    I'm also disappointed that the Judges on the circuit have not yet realised what a total waste of time/work/effort that the banks are putting them through. I know one or two judges are already striking out bank defences on this basis, but one would think that they would all be talking to each other on this subject as a matter of course !!

    Hi ladyc,
    You give the banks 8 weeks ( 56 calendar days ) in total from the day they received your request for refund. Probably 2 days after posting it.

    I've kept copies of everything sent/received and I've now got statement to show the money had been credited and withdrawn on the same day.

    It's very frustrating! Is it worth contacting legal dept myself and asking for offer? If so, does anyone have their contact details (HSBC)?

    I am not sure what to do. Do I accept the offer due to the recent happenings of judges taking the banks side.Do I contact the ombudsmen or do i ring the bank and see if they will offer me the full amount without interest.Really confused can anybody help.

    Errr...did you make a typo there ?

    A settlement of £24535 when you have only claimed £3993.86 sounds outstanding to me :)
