    Hello everyone

I was wondering if someone can help with this one!!

I sent a letter to the BOS in the middle of march and got a reply saying that it will take 8 weeks for my complaint so i gave them 3 weeks and sent my letter saying I will be taking them to court.

But when I cam round to applying for the court I never had any money to do it so I read on this site that they normally pay up after the 8 weeks so I said I will give them the 8 weeks.

anyway to cut a long story short the 8 weeks are up and I got a letter this morning telling me that they where satisfied that the charges on my account where correctly applied and they say if i am not happy (what I am not) I should got to the ombudsman with my complaint is this the best place to go now?

or should I give them a phone and tell them i am not happy with this reply and see what they say?

also can you please tell me if this is a standard letter?

    thanks
  • I,ve sent a letter before action for charges of approx £5000, received a letter denying an wrong doing from Lloydstsb yesterday, offering £750 as a goodwill gesture as full settlement. I have contacted the ombudsman, should I also speak to Lloyds about the £750 which was paid into my account last night?

You need to read the Reclaim Help Thread where you'll find a basic start guide and a list of what you can and can't claim, you can't claim the interest if this is on normal overspending. Please read the post about Interest in the Reclaim Help Thread.

If you are convinced that the charges you are trying to reclaim are of the £25-£38 penalty charges type then write back to the BOS and say ....

If you consider the charges are correct, please give me a full breakdown and calculation of these charges. I expect your answer within the next 7 days failing which I will proceed with my claim

Thank you for this reply. I too have had a letter, but from Barclays, saying they disagree with my view that the charges are unfair.
I will reply using your suggested wording and the 7 days will tie in nicely with my 14 day timescale for court action.
    Thank you again.

All you have to do is write back to them stating that you will accept the 'goodwill gesture' as part payment without prejudice but you will persuing your claim for the rest of the monies owed to you.

Once you file at court there is an option to state any part payments received and you just deduct it from the amount you are claiming,

This forum is very quiet at the moment has everybody stopped posting or are they all at the seaside eating fish and chips?

I have spent most of the day looking for and printing off info for my court bundle I must be a bit of a sad case judging by the lack of other parties!

Oh well back to the reference books for supper!
