Hiya Agnes - have had the same performance with Newport & found out it was being transferred to Cardiff. Then I had a court date sent through for 14th August. You sound organised in getting your stuff together for court. We should give each other moral support as we're 'neighbours'!

    Hey Jayneo,

I may well see you at Cardiff County Court then as my court date for my showdown with First Direct is also on 14th August !!

    Hi Everyone

I can't believe how quiet it is on here at the moment! Anyway to get to the point, I received the letter from MCOL stating my case had been transferred to my local CC and the AQ dispensed with. Rang the local CC a couple of weeks ago and they said case went to the district judge on 18th May.

Still no news or date through the post or anything, time goes by and I've started thinking as you do.......

When I claimed through MCOL, I did so online. I entered the appropriate words got from the help sections in the POC box, pressed the button paid my money and off we went.......I did not send any info or supporting documents or anything else in addition, the help threads said to wait for the AQ, to elaborate on the POC etc. As a result of the AQ being dispensed with I hav'nt sent anything to anyone, so the district judge sits there assesing the case with the banks defence papers and nothing from me! I have to admit that this worries me, do I sit and wait for the CC to contact me or should I have forwarded something even if it is only the schedule of charges?

If anyone can help put my mind at rest or tell me I've screwed up somewhere then please do so before this whole thing consumes me all together!

    Thanks in advance
    Simon (the worrier)

I just want to clarify a point here,

When dealing with the courts, one always has to send a copy of correspondence to the court and the defendant.

I am about to send off my letters for the directions hearing. In this I will be asking that the bank provides a break down of how they arrive at their costs (which scares them witless as they know they are in the wrong).

The point is, because I am now at the stage of dealing with the bank's solicitors rather than the bank themselves, do I actually send the letters as one to the court and one to the bank solicitors or do I send the second copy directly to the bank ?

I've heard mention by a lot of people here that the banks do not deal directly with any of this when it has gone to the court stage and insist that everything goes through their solicitors ?

  • Question for Frugalpam

where did you send your letters to for Capital one.

I have sent the first standard letter along with a cheque for £10 to the address on this website, they have not replyed but have cashed the cheque.

I rang the number for Cap 1 customer services and they were very un helpfull, they told me that they could not help and the department I needed did not have a telephone, they gave me a fax number and I have faxed another letter to them some time ago and still have had no reply.

I'm a little stuck now as to what to do next, any ideas??????

    Thanks

    Bank: HSBC
Amount Reclaimed: £1404.23 (including interest) plus £120 Court Fee
Amount Repaid: £1419.02 plus £120 Court Fee
Story: I requested a refund of my charges at the begining of March, to which I had no response. I already had my statements as they were available to print out from the internet...FREE! Eventually I decided to take HSBC to court as I'd had no response, even after sending a second template letter. They defended the claim immediately and after completeing the questionnaire, I had no chioce but to sit and wait. I DID panic when I heard about Lloyds winning their case!! Anyway...I received a letter last week offering me a settlement, which I accepted!! I agreed to adhere to their terms of confidentiality in return of the money being in my account the next day...and it was!!! There were many stressful times and I wished I hadn't started this...but hang in there, it'll work out!!
    GOOD LUCK TO YOU ALL!!
Thank's Martin for your help...I couldn't have done it with out you and your fab website!!!

may i ask how long it took between filing your AQ and getting a settlement loffer? I filed mine on monday and hsbc have to file theirs by next monday

Hmm - I rang initially for the statements, and they were very helpful and sent them quite quickly. Thereafter, I used this address:-
    Capital One
    Executive Office
    Capital One Bank (Europe) plc
    PO Box 5281
    NOTTINGHAM NG2 3HX
I always sent letters by 'signed for' delivery, and they did respond within a week to 10 days (unlike Natwest who rudely ignored all my letters).
As they've cashed the £10 cheque for the statements you requested, then I'd write again to request them and point out that they have failed to send them despite cashing your cheque. Do make sure your letters are signed for - they can deny faxes or emails were ever received. You could threaten to report them to the Information Commissioner or the Financial Ombudsman.
Don't be put off - persist with them, as they do pay up in the end!
    Pam

PS Edited to add - there is a Capital One thread, where you can read and post with people claiming off this bank http://forums.moneysavingexpert.com/showthread.html?t=424509&page=43 This thread is really just for success stories.
