    Amount claimed £3140 including interest and £120 court fee

    started the claim back in February. I received 2 refusal letters saying I agreed to the t&c when I opened the account (20years ago!).

    Filed the MCOL, and Nationwide had 28days to defend. They filed a defence on the 28th day (11th June), and am now waiting for the court papers.

    Am getting really worried that I won't get the charges back as Nationwide don't seem to follow any criteria. If anyone has had this, can you post the outcome, as I don't want to go to court with them, but I really need the money back!

    Have phoned the court who advised that due to backlog I won't get the defence until next week!! I have emailed Nationwide solicitor to ask for the defence due to the backlog, but to no avail.

    Will keep you posted, but any words of advise/encouragement would be gratefully received.

    Hey,

    I would like some advice from people who have used the Financial Ombusdman. They are now dealing with my complaint and as far as I know they are waiting on the bank to send them my file and then asign me an adjudicator. Has anyone got timescales from dealing with the financial ombusdman or any advice?

  • I have just issued a county court claim against Barclays on behalf of my daughter. They keep fobbing us off with 'we're looking into it ' letters. I have never done anything like this in my life before and I'm very nervous about the whole procedure. We are only claiming £699 and can't believe that they are dragging this out. Very pleased to hear of your success.

    well im new to all this , so be gentle , please ,
    i have sent my claim to the small claim court , the question i have is does the 14 day rule in clude weekends or is it 14 days mon to fri ???? also does the 14 day rule start 5 days after you first logged your complaint to the court ,
    any body can help

  • :mad: Hope my case with Barclays is as successful as yours have been. Only asking for £699 on behalf of my daughter. Time consuming and worrying but I'm hoping for an offer soon. Thanks to Martin wouldn't have known where to start without him.

    Well Mogger, I think you are one of the unlucky ones who will have to go all the way. There were two other people claiming from my office at the same time as me, One was owed £2000, bank offered £1,500 so he took it. The other one was £800, bank offered £600 and he took it. Unfortunately some are picked on to be taken the whole way. Hang on in there, follow Martin's guide and you will get there! GOOD LUCK

    The 14 days includes weekends its not working days :D They have 14 days from the date your claim is deemed served, which yes is 5 days after the claim is issued

  • Hi All

    I'm trying to get my charges back from Halifax, and this morning got a standard reply "thank you for you recent complaint, sorry to advise you i am declining your complaint" etc. Is it worth me ringing the numbers on the letter or shall i send the second letter threatening court? Can i also reword the last paragraph to say " I look forward to a full response to this letter within 14 days, with a copy of your charge costs, broken down to justify to cost incurred to yourselves, otherwise ..." etc? In the reply they sent a copy of Understanding Bank Charges and it does put the price on but i wish to know how that figure is reached, is it a fair question?

  • I'm trying to reclaim £9,298.78 (thats without interest) back from Lloyds TSB on behalf of my Sister. They have refused the claim from the first letter, have sent 2nd letter last week, waiting on a reply. Can't see this one being easy.
