    The story:

    OMG I'm sooooooo happy:j after all the worry about the last 2 cases losing against LLoydstsb I am absolutely ecstatic.......read on....

    After receiving all my statements from the bank, I first wrote to them on the 8th of January asking for a refund and then had to go through the process of writing all the various letters that wonderful Martin :money: had advised. I then went through MCOL with my claim against them on January 30/01/07. In February they wrote to me with the "I am sorry you are still unhappy letter" etc, and told me that on this occasion they are crediting £470 to my account. (Which they did). I wrote to them (and got a certificate of posting) telling them that I do not accept this amount and to take it back as I was still going ahead with my claim. They never took back the money. I was then informed by MCOL, that Lloyds were defending the claim and it was being moved to my local County Court and that I would have to pay £100 to do so! I thought shall I shan't I as it had already cost me £120 for MCOL, but I decided to go ahead. I got a court date hearing for 20th June, in the mean time all this news that a man had lost to Lloydstsb was going on which frightened me a bit I must say. I got a General Form of Judgement or Order from the court last week saying that LLoydstsb had until 13th June 2007 to make a skeleton argument by 4pm, and in default the Claim is struck out without further Order and the Claimant may request Judgement in default. And guess what ...... I rang the court this morning and they told me the bank never replied, so I have WON!!!!!!!!!!!!!!!. I dont know how long it will take to get the money out of them but it's taken a good 6 months so far, but its been worth every minute. So keep on claiming........ at the worst all you stand to loose is your cost of the court claim - at the best you will received back all the extortionate charges they have made over the years!!.     Hi All

    I'm trying to get my charges back from Halifax, and this morning got a standard reply "thank you for you recent complaint, sorry to advise you i am declining your complaint" etc. Is it worth me ringing the numbers on the letter or shall i send the second letter threatening court? Can i also reword the last paragraph to say " I look forward to a full response to this letter within 14 days, with a copy of your charge costs, broken down to justify to cost incurred to yourselves, otherwise ..." etc? In the reply they sent a copy of Understanding Bank Charges and it does put the price on but i wish to know how that figure is reached, is it a fair question?

    Sparky, it's just a try on from Halifax. Tell them you want a complete breakdown of how the charges are calculated. Halifax are wasting their own time and yours with this, if they cannot provide a breakdown you must deem the charges are unlawful and just proceed to court. Let them know this

    Well done you .... it just goes to prove that the 2 cases Lloyds won by error has no bearing. Even Lloyds know they can never win

    Hi started this who process around 8 weeks ago, yesterday had a letter back form the bank saying without admissions of liability would like to offer £1487.00 towards the total amount you are seeking. I'm not sure if i'm having a blonde moment or not but to me that seems only a very small amout not sure if i should press ahead and take them to court...............

    I don't think I'd let them off - they still owe you over £1000 which is better in your pocket than theirs. You could let the FO pursue the rest, if you don't feel like the stress of taking them to court.

    One Charge Is For Own Building Insurance Fee £50.00 This Fee Was Added Because I Had My Own Insurance And Did Not Want There Insurance Can I Claim This As An Unfair Charge

  • just asked hsbc for my charges back,sent off the second template last week on thursday and today i have had a letter acknowledging my letter and saying they are looking into it,has anyone else had this response and how llong was it before they sent you an offer.
    I also have an iva with this bank but it was 2 years ago and the account is now closed could this be a problem.

    I received 2 letters declining my request for refunds on my 2 acc.(business and personal) with HBOS.The leaflet, 'understanding charges' was also enclosed and yes the amounts are stated. I phoned and asked if they could send me a breakdown as to how these figures were made up and was told they don't have the facilities to do this.They also advised me that the refund of charges, does not apply to business accounts, So my case has now been passed to the FOS

    As you can see from my post above, I was told that they did not have the facilities to do this. ie. provide a breakdown. As I am going through the FOS, should I put what you said regarding the charges being unlawful on my notes to the FOS
