    i did it this morning and have set up a group on my email client of all the email address listed so now its one click and they can be sent to all of them

    For ANYBODY who had requested a penalty free Termination and a PAC code, and then has subsequently been issued a PAC code and a notice that the full Termination fee will be charged (if you use it or not) you will be interested in the Following:

    Unsolicited Goods andServices Act 1971 Chapter 30 s2 (1) and (2)

    S2 Demands and threats regarding payment.

    (1)A person who, not having reasonable cause to believe there is a right to payment, in the course of any trade or business makes a demand for payment, or asserts a present or prospective right to payment, for what he knows are unsolicited goods sent (after the commencement of this Act) to another person with a view to his acquiring them [F2for the purposes of his trade or business], shall be guilty of an offence and on summary conviction shall be liable to a fine not exceeding [F3level 4 on the standard scale].

    (2) A person who, not having reasonable cause to believe there is a right to payment, in the course of any trade or business and with a view to obtaining any payment for what he knows are unsolicited goods sent as aforesaid—

    (a)threatens to bring any legal proceedings; or

    (b)places or causes to be placed the name of any person on a list of defaulters or debtors or threatens to do so; or

    (c)invokes or causes to be invoked any other collection procedure or threatens to do so,

    shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding [F3level 5 on the standard scale].

    The best bit about this act is Section 5:

    5 Offences by corporations.
    (1)Where an offence under this Act which has been committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary, or other similar officer of the body corporate, or of any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

    So MAYBE I will get to stare Mr Swantee :wave: in the eye after all.

    I ordered a Sim only contract on 21 April 2013 (3 weeks ago), when I log in to my account on T-Mobiles website my monthly fee has increased.

    I have not received notification of a price increase from T-Mobile, surely they can't increase my price only 3 weeks into my contract.

    Thank you to those who sent emails to Ofcom etc per post #813.

    If I'm honest the response was not great so not sure what impact it will have. If you can please do send that email as I am about to send something to EE/Ofcom/and the Media which SHOULD get this whole thing out in the open, and the more of you who have sent the #813 post (you can still send the #602 post too) the "bigger" this story will become.

    Remember I'm not just fighting for my case (I'm post Oct 2012 contract so it is just a matter of time before mine is resolved to my satisfaction) I'm also fighting for Pre Oct 2012 AND FOR EVERYONE who never sent a cancellation letter because TM, Ofcom and to some extent the media lead you to believe you could not!

    So don't be :silenced: stand up for your rights and SEND THAT EMAIL.

    I have only just found this thread but found it very interesting , both mine and sons phone are with tmobile and I received the price increase letter and was quite annoyed that was in a contract but the price was increasing!

    I have never had a price increase whilst on a contract although this is my first one with tmobile I will be looking elsewhere when my contract is up!

    I wonder if anyone can tell me why when I go on tmobile website their contract prices are still at the original prices? Not the increased prices? Penalizing loyal customers what a load of crooks!!

    Last time I checked it was still the old prices - that was about 2 weeks ago -so maybe just "milking" us mugs who they think are "trapped"

    If you read the posts from about 3 pages back you'll see there is a GOOD chance that T-Mobile have messed this up so badly that you maybe able to cancel -even if you have not already requested termination.

    By the way if your contract started on or after 1st Nov 2012 I reckon you have as near a 100% certainty of being able to cancel - with a penalty - as you can be with English Law System.

  • This article relating to a 2011 orange mid-term price hike has an interesting quote from ofcom:

    ‘Whilst we do not believe that there is a case for us to investigate this general matter, whether or not individual consumers suffer material detriment will depend on the individual circumstances in each case, and customers can still contact Orange if they think they have or will suffer material detriment and be prepared to provide evidence to support their claim. Further, where a customer has concerns that Orange has not met its terms and conditions the relevant dispute resolution body, CISAS, may be able to consider this.’

    i.e. if there is a price increase and it would cause you to suffer material detriment - you are entitled to terminate your contract without penalty.

    Unfortunately, in their wisdom, ofcom has decided that all you need to do is convince the network of this. Yeah...

    For anyone that can prove the price hike will cause you material detriment it's definitely worth writing to your network. The CISAS will back you up if your network is not as sympathetic as you expect.

    There doesn't appear to be any time limit to your right to cancel in this case. Can anyone clarify that?
  • Just to clarify how ridiculous the quote from Ofcom in my last post is:

    Ofcom are asking customers to write to their networks and provide evidence to support the fact that they have been affected by a term that Ofcom invented and yet refused to define.

    'Material Detriment'

    Ofcom allows networks to make up any definition they want for this term, whenever they want, however they want.

    Absolutely bonkers!!

    I think it is it is long overdue for Ofcom to define 'Material Detriment' if they expect customers to prove they are affected by it!
