    There is something wrong with all of this mid term price nonsense.

    If everyone sends the email in my post #813 we can "prove" that OFCOM has been ineffective in the T-Mobile price rise:

    Q: When does BEFORE mean AFTER
    A: When it is in T-Mobiles T&Cs which have been REVIEWED by OFCOM!

    The above is obvious if we can get enough media attention on that we can open the debate into a wider context on mid-term price rises. THEY HAVE BEEN IMPLEMENTED ILLEGLLY as te OFT rules are VERY CLEAR (just that OFCOM does not understand them)!


    Page 58 ofthe OFT guidance, relating to price variation clauses, states:

    12.4 A degree of flexibility in pricingmay be achieved fairly in the following ways.

    • Where the level and timing of anyprice increases are specified (within narrow limits if not precisely) theyeffectively form part of the agreed price. As such they are acceptable,provided the details are clearly and adequately drawn to the consumer'sattention.

    The price rise clause is buried in clause 7.2.3.3 is not highlighted and when I took my contract out the advert made no mention that the monthly figure quoted was an INITIAL rental - it was just listed with al of the fixed items - Term, Minutes, Texts etc.

    Even if the intention was not to hide or mislead the consumer the fact that 99.9% of mobile phone customers were totally shocked that the price was not fixed is EVIDENCE that the rule was abused!

    I think you have six years to apply for your money back! So lets show OFCOMS ineffectiveness on the clear BEFORE and AFTER clause - AND THEN we can look at the wider issue (I assume Watchdog will support us here)

    You may be interested to know that The Express deleted my email on T-Mobiles behaviour WITHOUT even reading it. Not sure why a NATIONAL Newspaper would not want o run a story that effects 2 million T-Mobile customers - and the wider public interst re the EE directors reckless decision to guess RPI, when the company is looking to float on the stock exchange - I have!.

    Dear Sir,

    I notice you have deleted without reading a story that not only affects 2 million T-Mobile customers, but also the public and investor interest as EE directors - (EE are looking to float on the LSE later this year) have shown that they are (In my pinion) not fit and proper persons to be on a Board as demonstrated by their decision to take an enormous (reckless?) risk and "anticipate" the March RPI rate 46 Days before publication!

    Can you please let me know why you do not consider this to be a story of National public interest (I would not want my pension fund investing in such a risk hungry company).

    Thank you to those who sent emails to Ofcom etc per post #813.

    If I'm honest the response was not great so not sure what impact it will have. If you can please do send that email as I am about to send something to EE/Ofcom/and the Media which SHOULD get this whole thing out in the open, and the more of you who have sent the #813 post (you can still send the #602 post too) the "bigger" this story will become.

    Remember I'm not just fighting for my case (I'm post Oct 2012 contract so it is just a matter of time before mine is resolved to my satisfaction) I'm also fighting for Pre Oct 2012 AND FOR EVERYONE who never sent a cancellation letter because TM, Ofcom and to some extent the media lead you to believe you could not!

    So don't be :silenced: stand up for your rights and SEND THAT EMAIL.

    Any shareholder can ask a question you only need 1 share. However from experience of these type of meetings, most shareholders will be big pension companies who just want good returns, not care how too much.

    Grrr those guys on the other side off the world are about as much use as a chocolate teapot as they all read from the same script,

    T-Mobile now have 14 days to respond. Originally CISAS would not not take the case on and said I would have to wait 8 weeks, however after forwarding T-Mobiles 'I am sorry you remain unhappy however as I have provided confirmation of our position your complaint is not upheld and with regret any further communication regarding this matter may not be responded to.

    I trust I have confirmed me final position on this matter.
    ' they now accepted my case.


    I am on pre Oct 2012 contract.
    I submitted my complaint based on breach of contract although the CASIS letter does not acknowledge this.
    It's wait and see on the 'damages, counter arguments'
