    Hey Guys,

    I have not read all of the 41+ pages but I was interested to read that other people are baulking at T-Mobiles price increases. This has never happened to me when in contract before & I think its a disgrace!

    For those that are interested, here is the letter I sent them cancelling my contract (sent to customer administration in Duxford):




    Dear Sirs,


    I hereby terminate my pay monthly mobile telephone contract with T-Mobile. I have also given notice by telephone –in accordance with #7.2.2 of your November 2010 pay monthly telephone terms version 58A.


    Further to the above, your price increase of 3.3% is higher than the Retail Price Index percentage dated 19th March 2013 covering the month of February as documented on the Office for National Statistics website as 3.2%. As such you have

    Please note: No summary enforcement is allowed where there is a genuine dispute meaning you cannot collect disputed sums as debts.

    Please also note: You sold me a discounted phone on the basis that I entered into this contract with you, I have now terminated the contract in accordance with its terms and the law. Blocking the IMEI number of the phone you sold me will clearly be illegal and malicious. I will take you to court to have any block removed and seek recompense and damages for any time the phone is unusable.

    1. You have made one mistake in your letter - and only one mistake - and that is you assume that you are dealing with an honourable company that TM will abided by its T&Cs but IT IS NOT AN HONURABLE COMPANY! The fact that the rest of your letter is spot on will not matter to them (trust me on this!).
    2. I wrote to T-Mobile and quoted GENUINE DISPUTE and that I was withdrawing my authority for them to take any further sums until the dispute was resolved (I did not cancel the DD)
      1. They still took the next payment!
    3. I Have requested a PAC code be issued (without penalty to me) and what have they done?
      1. Issued a PAC code and will be billing me £249 cancellation charge - EVEN I DON'T USE THE CODE (will refund the following month if not used)
      2. I phoned and said I have only ever asked for a PAC on the basis of non penalty and they said they would investigation the mater -they have and the charge still stands!
    My advise to you is - DON'T cancel the DD - they will just mess up your credit record. Rather continue to pay and then when you win the case they will have to refund the sums taken ILEGALLY from your account.

    Please forward my "standard email" email to OFCOM as per post #813

    Messages from customers on Facebook say there is a big delay on refunds and, rather than get them the following month, several months have passed without any sign of a refund.

    Seems T-Mobile also look on its customers as a way of borrowing money for free.

    A quick request for everyone.

    Deutsche Telekom, one of T-Mobile's owners, has a Shareholders Meeting on May 16, 2013. If anyone can find any email addresses for interested parties then let us know. These are the people we need to inform on how T-Mobile is performing. If the investors don't like what's going on then something might be done.

    No doubt Mr Olaf Swantee :wave: will be at the meeting so let's get some interesting questions put before him.

    Thanks for your advice RandomCurve. Ill have a look at your letter to Ofcom now.

    Regarding your point about the direct debit, I have cancelled it and I have already got a PAC code and transferred networks. I have also swapped phones with my g/f who is living in Russia in case they block my IMEI. The reason for these precautions is that I do not have a single iota of trust in T-mobile! I have therefore tried to strip them of any power short of persuing me for payment.

    Their move.

    The ridiculous thing is that the regulator Ofcom allows networks to increase prices however and whenever they see fit as long as they* (the network) do not consider the rise to be of 'material detriment' to the customer (& they give sufficient notice).

    So if T-mobile decide that a rise of no more than 10% per month is not of 'material detriment' - according to Ofcoms General condition 9.6 they can raise the contract price by this amount every month.

    This is clearly ludicrous and everyone knows it.

    I don't think that T-mobile will even try to get a court order for the early termination fee they will likely accuse me of owing them.

    I think they might try to smear my credit rating and block my IMEI just to inconvenience me & put others off. Without persuing me for payment their stance is hopeless & I'm confident ill be able to remove the credit smear & phone block.

    Of course, I could be wrong. We will see.

    Please see my post #813 and send the email!

    So far SIX emails have been sent (thanks to those who have), but it's early days yet. Remember the intention is to get OFCOM to rethink its position (or possibly actually LOOK at the position) and to FORCE T-Mobile to give EVERYONE the right to cancel - even those who missed the original 30 Day deadline.

    So if you never had the time to waste on the phone with customer services and then to write several letters which you might just as well have sent to Mars for all the notice T-Mobile take Then just do this ONE thing!

    I can't promise that it will happen, but I'm damn sure it won't if you don't send that email!!!

    I am currently drafting a response to the latest piece of rubbish TM have sent me as to why the price rise stands. I will CC my response to all of those on the OFCOM distribution list and some additional Journalists and Reporters that I have been speaking with over the last few weeks.

    I am hoping that by including them into a "live" response to TMs nonsense they will realise that I have not been making up - what must sound to anybody not trapped in the twilight world of the TM legal department - an absolutely absurd and outrageous story!

    The above action should force TM to come to the press as a "no comment" (Hello Mr Silent Swantee :wave:) will not reflect well on them and then finally we may get the publicity we need.

    The pressure on TM to come and talk to the press intensifies with EVERY additional email (post #813) sent so PLEASE get those emails in over the weekend. TOGETHER WE CAN WIN!
