    This was on his FIRST DAY in charge, just shows his attitude and manner.

    This is the Executive board, and he's done just as you say. However the Board of Directors has Deutsche Telekom as well as France-Telecom people.

    Would you believe that in the midst of all these complaints that Jackie O'Leary, Chief Customer Officer is still away. Strange that the person in charge of customer operations has been unavailable all the time this has gone on.

    Seems she's just as evasive as Olaf Swantee.

    Depend where you are in the proceedings I had written it for CISAS and Small Claims court proceedings. However if you are not at that stage I guess you could send it TM. The upside of that is that you can then post the response you receive here so we can see if we can shoot that down too! :)

    I did not get time to mention this before.

    Yesterday I phoned CISAS again to find out what is and what is not a deadlock letter. They said that anything from T-Mobile that states either you are at deadlock OR states something along the lines of ".....we suggest you seek third party/outside advice" WILL COUNT as a deadlock letter

    Anything that just says "we will not communicate further" does NOT count as a deadlock position, and therefore you will need to wait 8 weeks. They also confirmed that you can go direct to the small claims court.

    You could go to a main court if you are a millionaire and can afford to lose nothing in law is a 100% certainty! (cost nothing if you win).

    I did say that by waiting 8 weeks that would be 3 months after the price rise was announced and customers would have lost their anger and therefore T-Mobile can substantially reduce their liability just by refusing to go to deadlock. The response was - Sorry but that is OFCOM rules (Now remind me - does OFCOM regulate or protect the Mobile companies - I can't seem to recall)!!!

    Whilst I had them on the line I asked if T-Mobile only paid an annual subscription to CISAS or a subscription and a case by case fee. At first they would not say, but then admitted it was both a subscription and a case by case fee. So then I asked the next obvious question - How much is the case by case fee, and for some reason they would not tell me. When I said I'll send in a Freedom of Information Request (FoI), they responded that I can only do that on my personnel data, so I had to explain the difference between The FoI and the Data Protection Act! - which is a little worrying given these are the folk who are going to review the legal arguments of our case.

    You will see in that email that just because May 9th has past it may still be possible (if we win our cases) that even those who have NOT requested termination will get a second chance. This can ONLY HAPPEN if we can get OFCOM to act as REGULATOR OF and not PROTECTOR OF (in my opinion) T-Mobile and that is the aim of the email - the more of you who send this the more likely OFCOM is to act!

    Have you considered if the complaint is about OFCOM it might also be sensible to mail Parliament as well?

    I thought of him, but I felt it was more likely that the Opposition members of the Committees would be more likely to stir it up a little, and perhaps ask some questions of OFCOM.
