The final versions is complete, and I have sent it for proofing reading, assuming they have time now, and there are not too many changes then I'll post the whole thing from start to finish tonight. This has been possible because further review of the arguments have meant some of the detail in the original is no longer required.

The POST Oct 2102 needs tidying up and I will do that , but essentially it is as posted before PLUS a query on if the T&C 7.2.3.3 is actually fair due to the inclusion of the word "reasonable".

ongoing with the CISAS, have listed it in the complaint

i have also sent TM a bill for the replacement phones, and still had no reply

Have you made a DPA request for your records? Any action on your account leaves a footprint, you would know exactly who did it if it was done by a T-Mob staff member.

I've just searched the T&C and can't find anything either.

I've just sent my complaint into CISAS so will start this as a new complaint. Mr Swantee is due to get another email off me in the morning.

I've just got off the line with Customer Services. Apparently someone with the ID50047561 asked them to send the PAC and add a termination fee, which is strange as ALL of my letters and emails and in all conversations with the Exec office I have clearly stated ".... without penalty to me". The money comes out on 22nd, but they have passed to their investigations unit who should respond within 7 days - so now it IS ABOUT THE MONEY :)

I have ben calling the media to try and breath some life into the EE directors story (post #602) Two seem quite interested so if you could keep sending that email that would be great.

i had to send proof of ownership to my new supplier to prove they were mine. i have it in writing from them that TM blacklisted the phones. TM refuse to accept my receipt's as they come from a third party, namely Amazon that is who i purchased them from.

The new provider has been very good and says TM told them i need to get the receipt from the original supplier, so told them i would sort it hence the demand for payment, cost and compensation, they now owe me more than i owe them

Why I should cancel my contract -Financial Reasons!

If TM offer to cancel the rise most of us would save £10-£20 over 12-18 months, however if you cancel the contract you can:
    • Go SIM only - which could save you £10pm for 18 months - £180, or
    • Sell your phone for say £40-£100,
      • Take a new contract via someone like "Quidco" who may pay you £40-£100
      • And get a nice new phone on a contract which was about the same price - or - less - than the one you are on now
So £80-£200 in your hand and a new phone -all for the current contract price.

So don't be swayed by any "sweetener" to stay with TM UNLESS they can match £100-£200 saving!

It sounds as if you've had the same treatment as me. Customer services did mumble something about an ID but then give me the name that went with it - Liam Walker. Unsurprisingly it's the same guy I've been emailing all along. The same one that said "if you use your PAC, this will incur a cancellation charge."

Apparently I authorised him to go ahead with the charge, I hope he has proof of that ;)

You did better than me - I never got a name - but I am guessing Mandy Lowery, However at the end of the day it is all down to SS (Silent Swantee ).

So I'm going to take some legal advice to see if I can "strip away" the company and pursue him directly in the small claims court - a few quid might not matter to him, but I want to look in him in the eye when he is trying to spin his yarns!
