I have already done just that, it maybe just an automatic text but have emailed the Executive Office again to restate the fact we are still in dispute that they do not have the right to use the direct debit.0 -
Could I ask, when did your contract start, and also what has EE told you is the RPI rate they used?
Did you forward the deadlock refusal to Ofcom?
Hi Anna, thanks very muich again for your help. I will be on to CISAS tomorrow and also Ofcom for T-Mobile's refusal to issue a deadlock letter, even though they have inadvertently done it anyway.
To answer your other question, the contract started October 2011 and the letter I got from T-Mobile about the increase was very sneaky because it didn't mention the % increase... it merely said:
"The price of your T-Mobile monthly plan will increase by £0.52. The bills you receive from 9th May 2013 will show the new price for your plan, of £16.38 a month."
Having calculated it back though, it does appear to be 3.3% increase as others have had.A big believer in karma, you get what you give :A

I did flag this up quite a few posts ago, but the pre October T&Cs PDF was actually edited in February of this year. Anyone still have a paper copy of this version. I'm happy to go through word for word to see if they changed anything. Just don't trust them!
I have a hard copy of "Version 58A dated November 2010" if thats any good? Not sure if there were any other revisions inbetween?
EDIT: Just thought i'd log in to my T-Mobile account to see if the T&C's on there were the same as the hard copy I have - make sure they hadn't done a cheeky swap on me..... anyway when I click the link to the T&C's from in my account, I get this page:

I'm pulling all the arguments together at the moment for the PRE October 2012 Folk - this is going to take me an age - I will endeavour to have it to all those who have emailed by sometime tomorrow evening as originally promised (or to post if we hit a 1,000).

They seem to have moved a number of their pages, the version they're showing online is 58A dated Nov 2010. The hard copy I have is version 58 dated May 2009. I'm not sure what the differences are.0 -
Its the version 58A hard copy I'd like to see. If you download the PDF of version 58A then click file and properties you'll be surprised! Surely it should not be edited after the stated version date? And its suspicious to me that it was done in February right before the rises?0

Thank you for your email dated 23 April 2013 addressed to Jackie O'Leary. I have been asked to respond on her behalf and keep her informed of any action taken.
I am sorry you are unhappy with the recent price increase. As a company we are committed to offering the best value for service which is why we have kept the increase to a minimum. The increase is a result of the rising costs to our business and is in line with the Retail Price Index (RPI), which is a measure of inflation.
Our terms and conditions give us the right to increase our price plan charges provided the increase is no higher than RPI and we provide customers with written notice of the change.
Clause 7.2.3.3 of these terms and conditions state that the relevant rate of RPI will reflect the 12 month period before the month in which we send customers written notice.
We wrote to our customers between 02 April and 08 April 2013 informing them of the changes to their price plan charge. In accordance with our terms and conditions, the relevant measure of RPI should therefore reflect the period 1 April 2012 to 31 March 2013.
The Office of National Statistics published its official rate of RPI for this period in April. The official measure of RPI for this period is 3.3%. This is in line with the 3.3% price increase that will take effect from 10th May.
This means that customers wishing to end their contract with us, in accordance with clause 7.2.3.3, will not have the right to leave without providing us with 30 days notice or paying the cancellation charge that may apply.
Although this may not be the outcome you were hoping for I trust this clarifies EE's position on this matter.
