Its great to have some advice on this, it's greatly appreciated.
One question, what is reasonable? Asking for just termination of contract without penalty AND the refund of payments since May 9th? Or just termination without penalty?
Decisions decisions.
I would ask for back dated termination to when you first requested that T-M comply with the contract and give you a penalty free termination, as anything else gives rise to T-M benefiting from not complying with their own T&Cs.
I don't think the SCC can offer "compensation", but only reimbursement of costs so you might not be able to add £50 for compensation unless you can dress it up as "sundry expenses" - paper, stamps, ink etc maybe £20 - they can only say no and what you don't ask for you won't get!

I have now received TM defence to my SSC. They have used almost cut and paste from the CISAS document apart from a section where they say claim did not succeed.
I would like to use evidence of successful claims in my submission ans would be grateful if any one who has won their case could sent a copy of their successful decision to [EMAIL="tmdispute@gmail.com"]tmdispute@gmail.com[/EMAIL]. This email has been setup purely for this purpose and will then be removed - if you wish to take out any personal information that's fine I will not retain any of the document once the case has completed. Thank you to Ann007 and randomcurve who have already offered their CISAS decisions to me

For anybody interested CISAS have ruled that the Orange Price rise clause is not compliant with the OFT UTCCRs 1999 and is therefore UNENFORCABLE - this dose not allow you to cancel the contract but does mean that Orange are not allowed to increase the price over the term of your contract - any rise/s already implemented need to be credited back to your account!

Part of the ruling was for T-Mobile to refund any charges incurred since the 9th May. Im in no rush to get a new phone/contract at the moment and if I can get away with another two months free line rental on behalf of T-Mobile it seems like a bonus!

Hi all, has anyone produced a brief guide on how to get things rolling with this? Or worse still, are we too late? Mar 12 was when my contract started.
I've read dozens of pages in here but all I keep seeing is what to do halfway down the line. Where do we start?0 -

Are we too late? This s good question. As TM are losing the cases because the implementation of the price rise breaches the UTCCRs then you are NOT TOO LATE.
Have not got any time at the moment, but I will put together a short step by step guide early next week (Monday if I can).0 -
