Currently going down the SCC route £35 to start, TM are defending the claim and are suggesting the mediation route. Documents with the courts and I have agreed to start with mediation which is free, Understand if that does not work and it goes to court there is a court fee. I sent the below to Lynn Parker and Graham at Ofcom and copied in Olaf Swantee :wave: and some journalists. It will be interesting to see if TM can move mine along in accordance with the time scale - place your bets please!

I have forwarded the attached to you as it is a clear instruction from CISAS to T-Mobile to comply with the adjudicators decision in my case by 16-9-13.
I have heard from many others that T-Mobile are continually missing deadlines to comply with CISAS rulings (by several weeks in some cases), which has prompted some customers to resubmit claims to CISAS against T-Mobile for their total disregard for CISAS (it seems it is not just the customer and Ofcom that T-Mobile appear to have contempt for).
I will include you on all future correspondence on this so you can see first hand how one of the companies Ofcom is supposed to regulate actually operates (or maybe in this instance I'll get special treatment)?

Also it maybe that you can only get the price rise stopped and not the contract cancelled depending on how we approach the 30 day clause in the T&Cs and how that plays with TMs behaviour and Ofcom's announcements in the MSE article of 7th May.0 -

If going down the mediation route then ask for £100 compensation (you can use that as a bargaining tool) on top of the costs you have incurred (i.e. court fees) and don't accept any offer to reduce your price plan etc -unless it is better than you get on sim only elsewhere - as I'm sure you can win at SCC (but won't get any "damages/compensation - just reimbursement of costs).

is there anyone else i get in contact with (someone high up that as the clout to sort things out) be it email/phone apart from guy perring( whos away until sept 3rd) or carmel codd, (whos not doing anything of note to resolve the refund) not even bothering with customer services as they dont have a clue just go round in circles with them0

I requested an unlock code in May which took over the 20 days and I'm awaiting another unlock code which the 20 days was up Yesterday.
My belief is that them saying it'll take up to 20 days and me agreeing to pay on these terms is a contract which they have breached.
I've therefore asked them to refund my money or I'll be looking to go down the CISAS/Small Claims route
I know this is slightly off topic but still relevant once you're ready to leave.
I got an email from Carmell Codd last night saying the charges had been refunded to my account0 -
