For TM to claim that terms dated before 31 Oct apply to a contract started in December shows just how desperate they are, but it's probably about the best move TM can make in the circumstances
I think they are desperate - and that this is deliberate - as in ALL of the correspondence with me TM have referred to clauses in V59 of the contract, and I will highlight that to the adjudicator along with dates of TMs T&Cs and my contract.
The above said in mid May I received the first email from TM which stated " this is our final decision" and that - and only that - email quoted the clause from V58. So maybe that was the date they began to "falsify their records" in preperation for CISAS cases. Fortunately I immediately replied that they had used the wrong T&C in that email and they acknowledged that and apologised. That email exchange is included in my original CISAS application.
So if anyone else on V59 receives an anything from TM quoting V58 challenge it and include it in your CISAS claim.0 -

I just checked back though the TM letters regarding my post-October claim and not once do they explicitly mention which T&C's are the relevant ones or the actual wording of the relevant Clauses.
They only ever give their interpretation of Clause 7.2.3.3, ie. that it means March's RPI.
It does look like they are trying to muddy the waters on the post-October claims, in the hope that CISAS confuses them with the pre-October claims.
Not that that will work in their favor, based on the majority of the decisions.0 -
The other relevance to this TM nonsense is to compensation. If you have claimed an amount by way of compensation, it may be worthwhile briefly pointing out to CISAS how obviously frivolous TM's case is (by reference to them using the wrong terms) by way of justification of your compensation claim and this may also make the adjudicator more sympathetic to your claim.

Magical question - what is the best way to go after you won the CISAS case??
Did anyone who won the case earlier can give some advice?? I am somewhat reluctant to call customer services and as for PAC because in case that they will charge me now I will not have enough money and it will be troublesome to reclaim the money and all.
I am quite sure that in the end they will definitely allow you to leave without the penalty but as everything is a guess with them I am looking for best approach to avoid any charges now.

I received an unsolicited PAC by text and letter after the CISAS judgement.
I have used it, and have since had a final bill from T-Mobile with a credit amount showing.
I'm just waiting for the refund now.
If you have the decision paperwork from CISAS showing their decision to allow cancellation and supply PAC, there is no way T-Mobile would try any silly business with ETF charges.====0 -

After using the PAC, and porting without problems, I received a letter from TM giving my PAC and stating my bill would show a "Notice Period Charge" and a Early Term Charge" but this will be standard on all their letters.
I then received a letter from their legal team saying that all charges after the date I first gave notice would be waived. It looks like the account is closed as I can't access it online. As far as the refund and compensation are concerned, I would think T-Mobile will wait until the end of the time allowed for in the adjudication.
So while CISAS didn't ask them to provide a PAC it looks as if they would have anyway. It can't harm to ring and ask for one though, and despite what they say they can't charge - remember the person you speak to at TM won't know about the adjudication. TM will close your account once the PAC is used, or by the final date they have to comply with. So make sure you've ported your number out before this date.0 -

I had to call customer services and explain what happened, they issued the PAC but they couldn't waive any of the charges so I just cancelled my direct debit. After a few days I got a final bill with a massive termination fee and contact from someone in t-mobiles legal team. My account is showing in credit so I'm just waiting for them to send the refund.0
