The other relevance to this TM nonsense is to compensation. If you have claimed an amount by way of compensation, it may be worthwhile briefly pointing out to CISAS how obviously frivolous TM's case is (by reference to them using the wrong terms) by way of justification of your compensation claim and this may also make the adjudicator more sympathetic to your claim.

Although I am entirely speculating here...

My compensation claim is high - based on £50 per letter from the 2nd time they pretended they did not know the difference between BEFORE and AFTER. I informed TM I would charge them that rate and 8 letters later all with response from TM they have never queried the charge (oh and plus £50 for filling out legal forms and £50 for invoice preparation). I said in the letter that this was so simple they must be deliberately trying to frustrate my right to cancellation and making me work - therefore they need to pay me for that!!!

In their defence TM have stated that my compensation is disproportionate and that I have not provided evidence. But I have by virtue of the emails sent (all included in the claim evidence).

Still have to win the claim first!!!!

I just checked back though the TM letters regarding my post-October claim and not once do they explicitly mention which T&C's are the relevant ones or the actual wording of the relevant Clauses.

They only ever give their interpretation of Clause 7.2.3.3, ie. that it means March's RPI.

It does look like they are trying to muddy the waters on the post-October claims, in the hope that CISAS confuses them with the pre-October claims.

Not that that will work in their favor, based on the majority of the decisions.

They never said which version of T&Cs they use in any of my letters either, but they did quote the V59 clause - and then went on to explain that by using the rate "as close as reasonable possible to the date of the letter" they could apply the March rate - completely ignoring the "published before" part of the T&C they had already quoted.

Evening all, i've been waiting a while for the results of the Ofcom review of mid-contract price increases. Not seen it reported elsewhere which surprises me but the findings are here:

    http://stakeholders.ofcom.org.uk/consultations/price-rises-fixed-contracts/summary

Looks like very good news for the consumer and that mid-contract price rises will be "avoidable" in future (if I read it correctly).

    EDIT:

Looks like that was Ofcom's proposal BEFORE the consultation opened. Still awaiting their decision... wonder when it will be?
