Will happily post the process I went through and letters sent should anyone wish. Don't give up, keep going through the process. So satisfied with this result, TM tried every available tactic to them and this is a great victory for the consumer, I hope more and more people see this through.0

How long did it take for the decision from when your adjudicator was allocated? And who was the adjudicator?
By tomorrow I will have been waiting three weeks for a decision... ever get the feeling your case is sat in someone's inbox while they get on with other things?Admittedly they did change my adjudicator once due to "unforeseen circumstances" but I get the feeling I might soon get the same letter and be moved again....

Just received a reply from T-mobile, should I consider this as deadlock or I need to wait 8 weeks from the initial email that i sent:Dear Mr YYY,
Thank you for your email dated ZZZ 2013. Please accept my apologies for the delay in my response I have been out of the office.
I acknowledge the comments you have made and I have confirmed with our Legal Team our position remains the same. As you have requested your Port Authorisation Code (PAC) I have provided this for you below:

This PAC will expire on the 06 August 2013, once this has been used your T-Mobile account will close with immediate effect and you will receive a final bill. As you have cancelled your account early an early disconnection fee will be applied to your final bill as per the Terms and Conditions.
Whilst I appreciate you may remain unhappy with this decision, I trust I have explained my reasons in full. You would need to seek independent advice if you wish to take this matter any further.

I sent my response to CISAS via email regarding TM's defence last Sunday 30th June, I had already been assigned an adjudicator however had been on holiday so applied for an extension. Got the email about 1 hour ago with the decision.

Massive thank you to D123, anna, random.
Just received our response from Cisas, found in our favour pre Oct contract.
We cancelled the contract refused to pay the ETF, they have been ordered to waive the fee and refund back dated to when I first notified TM of our intention to cancel. Furthermore they also ordered TM to pay £100 compensation for their failure in their duty of care.
Another small victory for the customer.

I make the score 8-2 to the customer on Pre Oct Contracts and 1-0 to the customer on post Oct Contracts.
I really can't understand we have 2 loses? Stoney/Ruflonger you need to go the SCC
I'm going to try again to see if I can muster any media interests -but what with Andy Murrays win yesterday and the imminent arrival of a new Royal this may not be an opportune moment.0 -

Can I ask what reasoning they (Cisas) gave for rejecting your complaint? I don't understand how there can be any losses provided you gave the immediate notice? The adjudicator stated in my summary that they were "particularly struck by the change in interpretation" on TM behalf to how they handled the price rise in 2012. They also state that neither party could rely upon an unknown RPI rate.
Can you not challenge Cisas findings based on the outcome of other customers?
It seems to be a case of including certain evidence in your complaint to win this.

That will be considered as deadlock.
Within this thread there are all the relevant pieces of information that you need to understand and quote in your evidence. Search for posts by Randomcurve, anna2007, d123, they have kindly done all the research and simplified it.
My advice would be to make sure you understand the facts you are basing your argument on so that you can explain these in an way which is easily understandable to the recipient at cisas.
Do not base your argument on trying to prove that the RPI rate of 3.3% was wrong (even though it was/is). Your argument should be based upon the wording of terms 7.2.3.3 and your reliance upon those terms.

Well done to those with recent CISAS victories. I'm hoping that momentum continues in our favour.
Just got T-Mobile's defence to my pre-Oct complaint (and posted my comments) and even though my complaint was approached from several angles the defence was still a complete copy/paste of what has been put up on here previously.
T-Mobile completely failed to defend two of my issues.
Just waiting to hear which adjudicator will be appointed. My fingers are crossed.0
