I have a Pre October Contract and raised a case with CICAS the deadline for the T-Mobile response was last Friday, 5th July. I have not received any response either by email or by post.
The CICAS rules state
"If the company does not give us their response within the time allowed, we will appoint an adjudicator to consider only the information provided by the customer. We will write to the company and the customer to confirm the adjudicator’s decision."
Am I am being a bit premature thinking they haven't submitted one? Or can they still claim an extension after the deadline?
Thanks in advance.0 -

The response is to CISAS, not you.
They have until close of business Friday, you'll probably hear their defence via CISAS on Monday or Tuesday.====0 -
Thanks d123
I will await and see what their response is.0 -
^I love a good DEFENCE 'story' better than fiction and all for free! thanks money saving expertise :j
Remember just because T-Mobile is paying CISAS to make a ruling does not mean the same defence would stand in a impartial EnvironmEnt commonly known as Her Maj Courts & Tribunal Service
Really Ofcom making private not impartial 'ADR' companies rich was not how the legislative powers granted to Ofcom were meant to used. And a £35 fee to a small claims court would be a better investment for ALL parties time and monies.
Also remember a small claims court ruling in Scotland sets a STANDARD
YOU DO NOY NEED TO GO TO CISAS PEOPLE - YOU SHOULD GO TO A SMALL CLAIMS COURT AS YOUR FIRST PORT, but don't bank on Ofcom telling you anything of the like or truth against their licencees.SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe0 -
why pay to go to the small claims court when you can use CISAS for free (and in my case win) ? surely CISAS would be the best first option, if that fails then abviously small claims court would be the best 2nd option should you wish to use that route0

Hi. I have 2 rep(lies) from T-mobile with the usual crap and when I replied to them for the 3rd time I didn't heard anything from them for the last 5 days. How much I need to wait to consider the situation as deadlock and forward to CISAS? Thanks0

You have to wait 8 weeks from when you first raised the complaint with T-Mobile before you can take the matter to CISAS.
The only other option is if TMobile issue you with a notice of deadlock, meaning you can goto CISAS earlier - however T-mobile very rarely issue these.0 -

Or T-Mobile state in writing that it is their final decision and they might not respond to any further communication. This is basically unofficial deadlock, and CISAS accept it as such.====0 -

You know, you go from posting sense most of the time to posting nonsense when you log on after midnight (just staggered in from the pub?).
Many people on this thread (you did read the thread before dumping your block of words here?) have taken T-Mobile to CISAS and won.====0 -
Massive thank you to D123, anna, random.
Just received our response from Cisas, found in our favour pre Oct contract.
We cancelled the contract refused to pay the ETF, they have been ordered to waive the fee and refund back dated to when I first notified TM of our intention to cancel. Furthermore they also ordered TM to pay £100 compensation for their failure in their duty of care.
Another small victory for the customer.
Thanks again0
