    Hi there,

@MT87, I have been able to locate your Facebook post and I have taken a look into this for you. I can see that an update was provided on your claim on the 07/07/14, you will be able to view this via the Customer Care section on your account. Hopefully, we can get this resolved for you soon!

@bugeyed, thank you for your post. As you are aware, without the cashback being received form the merchant, we are not able to forward this on to our members but I can assure you that as soon as the cashback has come through, you will see your account updated to reflect this. I am sorry that you feel you have to go to such levels because of this but hopefully, the cashback comes through for you soon.

    Kind regards,
    Samantha

Small claims court is definitely the right direction to go if the issue isn't resolved. You can make a claim online from the Money Claim Online website.

Just out of curiosity, is your solicitor a no-win-no-fee type? Did she advise which legislation to base the case on (I am under the impression that the referrer market is not regulated)? I hope she has secured a confirmation from Sky as evidence that they have paid TCB for your transaction otherwise the case could well be a non-starter.

To be honest, I think this comment applies to all cashback from TCB.

I mean, how can TCB members know whether their cashback is really rejected by merchants, or whether the cashback is passed on to members as soon as TCB has received it, there is no evidence or whatsoever...

Offering a incentive to obtain custom is enough proof, the contract and emails are proof enough as set out in the trading regulation act.
If a incentive is offered to obtain custom it must be honoured unless the transaction has been cancelled, any site directing consumers to a business is responsible for ensuring that the incentive is honoured fully.
That is from trading standards and yes my solicitor has been in talks with Sky so she must have evidence if she is suggesting push it on to court now.
TCB do not have a leg to stand on despite their small print and they have lost a few times in small claim courts too (from what i've heard).
If anything i will simply vote with my feet as i know many others have done. Cashbackkings started the same bullcrap TCB are doing now and guess what, they are no longer in business.
It's in TCBs best interest to ensure their customers are kept happy, even by removing the companies who are causing the problem would be a huge step in the right direction but aslong as TCB ceos are getting their 400k+ a year eh?
