Cancelled Subscription via Paypal - Can I be forced to pay?

    I am in the same boat ... I cancelled through paypal before the end of the trial and now they are hounding me using Daniel Silvermans for £278! for a £19/month 'service'.

    I do not intend to pay but I am obviosuly worried about it being escalated. :mad:

    I thought this had all gone quiet but no...i got two 'this is the last and final warning' letters, which i binned and now i have an email saying 'as a last gesture to settle this amicably' pay a settlement of £139, this is from Daniels Silverman, another so called legal firm. Im not sure whether to actually respond saying politely to go away or to just ignore it. Anyone got any advice?

    Would advise you ignore correspondence from Daniels Silverman and/or LegalCare. They only seem to initiate court action when you respond to them in writing. Whether this is because you then confirm your name and address, I have no idea.

    There's quite a lot of stuff going on in the Consumer Action Group forums regarding LegalCare at the moment. There's a court case that's due in about 3 weeks so you might be best placed to check out the information on there too, if you haven't done so already.

    I've just moved from Australia and needed legal help. Found this website and etc etc got caught the same as others did in this thread.

    Anyways after getting help from a solicitor I wrote them an email stating that I'd be willing to take the 228 pounds to court and we have "Major" evidence against their company and will be using that evidence to win the case like "Other people have"(Lawyers advice).

    Anyways I got a nice reply from someone an hour later arguing against my points.

    To my surprise and shock the last line of what they sent was this:

    "I am sorry that you have decided to base your opinion of our company on the comments of a relatively small number of individuals who feel that they are under no obligation to adhere to our terms and conditions.



    I can confirm that given your current personal situation we are happy to close your LegalCare account with immediate effect, and no payment is required.



    I trust that this is acceptable to you."

    I'm grateful I contacted a solicitor about this issue, it was only 2 months overdue but it releases great financial stress off me since I have no money, no assets and need a job fast!.

    Having passed the 14-day trial, and paid my first monthly £19, I'm taking another tack. They claim to give legal advice in the form of questions and answers but oftentimes, when pressed for a simple answer, refer you to their solicitor service "at a 25% discount".

    This refusal to answer basic legal questions constitutes breach-of-contract from the point of view of cancelling payments. Anyone who has had that kind of 'answer' has a good chance of arguing their case in the small claims court; Legalcare will rapidly back down from such expense and embarrassment.

  • Hi I am in the same boat, I took out this service thinking after I get my answer I will cancel. I forgot stupidly and so after the first payment came out I cancelled 'However it said I can not cancel mid contract but my recurring payment had cancelled'. Still I thought this was a monthly recurring 'service' so that was the end of it just lost the first £19.00 payment. One month later and another payment is taken, I then look at their website in more detail and read the T&C's, oops what a mistake to maka. I am in a 12 month contract, which to be fair does say in small writing on the first page of their website, but we are only human and little writing at the bottom of the page I believe is not a fair way of saying you are in a 12 month contract.
    I am no expert but I thought you had a 'right to cancel' within the first 14 days and as the website says the first 14 days are a free trial period where I DO NOT have full access to their website they should not be able to have this as their cancellation period??? Can anyone confirm this either way?

    Quick update. I have emailed legalcare accounts and I have been offered a shortened term of 3 months for £57.00 but I only have 5 days to accept. I think I will to take away the stress, however I have a close contact who works for a certain well known TV programme aimed at dodgy trader's ripping off brits and has taken all this with a lot of interest and will try to get the researchers involved and hopefully we can try and stop more people getting trapped like this. If we can expose them in the public domain at the very least it can't be a bad thing. Fingers crossed for common sense and fairness. I will keep you updated with events as much as I can/allowed. On a separate note, why does this company have so many changes of director according to companies house?

    If you've paid the first £19, and thus owe £209 for the remaining 11 months of the first year, Legalcare may bully you but it's not in their economic interest to send a representative to court (make sure you apply to have any hearing transferred to your local county court) over such an amount. Over 90% of legal actions or threats are finally dropped or settled out-of-court. Incidentally, in court you have 'absolute privilege' to slag-off the company for deceptive advertising and misleading terms and conditions. That's the last thing they want the district judge to hear!

    Just stop your Paypal payments and ignore their threats. Chances are they'll give up or move on to the next sucker.
