Cancelled Subscription via Paypal - Can I be forced to pay?

    Happens all too often with some 'regulars'. Scan, post and run unfortunately seems to be the way. Often it's not helpful

  • I made the mistake of forgetting to cancel before the trial ended. I only realised after the first payment went out. I immediately contacted legalcare to try to cancel the contract, but received a response saying I was now signed up for 12 months. I know this was my error here, but I can't justify paying out that amount for a service I will not need to use again. So I cancelled the paypal payment.

    Legalcare then contacted me when my payment failed to go through - I advised them of the situation and that I couldn't afford or justify the cost, but as it was my error in not cancelling in time I would be happy to negotiate. I offered to pay 2 months (£38) to end the contract early. (an offer I believe to be fair to both parties). They have accepted this, and I now have access for the 3 months I have paid for.

    Maybe they are beginning to soften their stance?

    Before contacting them I read through this thread and others on different forums. I was beginning to worry as I really didn't want to get involved in a protracted argument with them, as unlike most of the posts on here, I didn't cancel before the trial finished.

    Having had the unfortunate experience of dealing with LegalCare 1 month ago (September 2013), I received their reply to my concern 'we suggest you contact the police' I did not think a great deal of their advice and decided to cancel immediately as I smelt a rat!! I did cancel my subscription via my Paypal account, due to not being able to find anywhere else on the site to cancel my 12 months 'subscription', that in itself to me is a 'con' as I didn't knowingly sign up for a 12 months 'legal subscription'. I just read 'free legal advice' on their website which obviously drew me to them. I have emailed their accounts department several times and they repeatedly reply with a bill for 12 months subscription charge payable in full then a second offer from them which was 2 months subscription if paid within 4 days which was their final offer. I then replied to them after seeking legal advice from my ex brother in law who is indeed a lawyer and he immediately told me to email them and explain my financial situation and mental health problems I am suffering, I have been declared bankrupt and gave them my bankruptcy ref no and they then replied with 'it wasn't our intention to 'hassle' you just to obtain monies for their services. I did mention at the end of my email to LegalCare a comment by my mental health nurse who told me I would be quite within my rights to take this matter up in court, their slightly 'threatening' letters asking for a full years subscription, then 2 months payments charge and then they have simply written the amount off as a 'gesture of goodwill' I wonder if they just replied to me as I mentioned I was already declared bankrupt and they had little chance of receiving a single solitary penny from me!! Please do not be taken prey by these so called 'LegalCare' professionals, they seem nothing more than con merchants and need to be brought to court. They are preying on peoples misfortunes, why else do you really need legal advice after all? I mentioned to LegalCare I was contacting BBC's Watchdog programme about my dealings then I immediately received a cancelled invoice from them!! Do not be afraid everyone, please I am a normal mother of two children housewife, but will not be put on to and truly believe these people are out to make a 'quick buck', but certainly not from me! Don't offer them any money, stand your ground, don't let them grind you down! The chances of them obtaining anything against you if you are genuine is virtually impossible. Their scaremongering tactics, threatening solicitors letters/bailiffs letters will be a bluff, I would put my life on it!:T

    Not been on here for a while, but thought I'd add to Kate's post that LegalCare/GPB seem to have stopped hounding me (problems started in March). As with Kate, taking a tough stance and demonstrating you won't back down seems to be key to dealing with this bunch.

    They were indeed. That's a result at least - they were the rudest legal firm I've ever dealt with.
  • I simply cannot believe this company is still getting away with this. I cancelled the same day as I subscribed as it was clear i needed more specialist advice. I cancelled through paypal believing that was the way to do it and now a debt collection letter demanding £ 278.00. I today have written a complaint to law society, to trading standards (now the citizens advice) and to BBC's watchdog. We simply have to stand up to this company taking advantage of people who are at their most vulnerable (which is why we are seeking help). I would suggest if you haven't already dine so do as I and lots of other people have and write to the above.

    Also if you go to companycheck.co.uk and type in aska professional ltd there is a feedback tab where you can leave a review of their company, if we leave enough they may get the hint.
  • I got stung by this nasty bunch. Still have a little outstanding but thinking of picking up the sword again after reading here and this from consumer action group forum on same matter: If they are insisting that you can cancel within the 14 day period but only if you follow precise instructions, I wonder if the High Court ruling by Mr Justice Kitchin (in the case of The OFT v Ashbourne Management Services Ltd) will offer some help. In his ruling and Penal Order made against the gym admin Co and it's Directors, the judge said that an agreement could be cancelled in a number of ways - by letter, by email, by face to face conversation, by phone or by deed, such as cancelling a DD mandate.
