Cancelled Subscription via Paypal - Can I be forced to pay?

    Hi everyone!

    Seems like I'm glued to this forum now, I haven't received a letter from the solicitor just yet, shall we all agree to support each other in case it goes to court? in a sense that will I be able to use your statements that you are in the same boat? I will do similar for any of you.

    I received an e-mail today from their accounts with an invoice for the total amount and giving me 14 days to pay... I responded with a rather long reply, basically repeating everything I had told Paul Careless, and that I would prefer to communicate with him rather than by e-mail. I also said that I would be happy to present all of this as evidence in court.

    I finished off by telling them that following advice from a local solicitor and the Citizens Advice Consumer Service that I wholeheartedly dispute their claim that I have a contract with them. I have asked them not to contact me by e-mail again and that should I receive any further demands for payment from either them or a third party, I would consider it as harassment.

    No GPB letter yet, I am not sure if my communication with Paul Careless has helped, I don't think am quite at that stage yet.

    Hi there, another angry victim here! I cancelled the free trial by cancelling the PayPal payment ,not through the legalcare website dashboard and have just received the solicitor demand for £278. I feel like I have been tricked by being drawn in to a very cleverly constructed website with the offer of free legal advice and "100% no obligation", which seems designed to entrap rather than making the method of cancellation clear. Yes it is in the terms and conditions but half way through the list of general stuff . Going back through the free trial offer to revisit the process the cancellation protocol is buried in the t&cs rather than being clearly visible on the main website. I think this is a devious honey trap designed to entrap often vulnerable people who may not be able to afford a subscription or indeed to pay for legal advice.

    Sorry to hear your another victim to this deceit - your certainly not alone.

    You may not have had opportunity to read earlier posts yet, but I recommend to have a trawl through to get upto speed on where we all are on this. Most have complained to Consumer Helpline/Trading Standards - that's your first port of call, get your experience logged with them.

    Some are also trying to get in touch with BBC Watchdog - again the more people that complain and raise the issue, the more likely somebody will take notice.

    Finally, some (myself included) are happy to go down the full legal route and let it go to court. Currently there is a lot of evidence in our favour, added to the fact so many people have been affected with the same issue. In my opinion (and also after consulting a solicitor) the risk is pretty small, however this is something you should carefully consider. Again, much more information can be found in the previous two/three pages :)

    Before anybody goes tarring everyone with the same brush over a single person's actions, it's worthwhile pointing out there are no less than 14 people that have reported the same problems with the same company within the space of three weeks or so. And heck, they're just the ones that have bothered reporting it.

    I think there comes a point where common sense has to step-in and really has to ask the question - why does this situation keep repeating itself? And really, given the evidence presented, the only viable answer to that is there is an inherent problem with the way they a) present their terms and conditions to the user and b) their (non-existent) cancellation process.

    imoneyop - totally agree with you with this being a public forum; everyone is entitled to their opinion of course. However, there is some merit to the saying:

    "If you've not got anything nice/helpful to say, your probably best off not saying it"

    Probably more so seeing as though these are forums that exist to help people, not attack or belittle them with comments whose sole purpose is to cause provocation.

    I appreciate some people will naturally disagree and where these T&C's are concerned, they may spot them without a problem. Good for you. However, a lot of people also don't. And there is a justifiable reason why that happens, as previously discussed.

    Some people do get scammed, some don't - that's fact.

    See the thing is there is a cancellation process and you saying otherwise does your case no good. I went through the signing up process and IMHO the T&C's are there and easily accessible. Some people are internet intelligent, others are not.

    LegalCare have changed their website again - the hyperlink to terms now actually changes colour and acts like a hyperlink when hovered over.

    Makes you wonder why all these recent changes are necessary if their sign-up process is so clear and understandable in the first place doesn't it...


    Still, note that they are making these changes but still failing to neglect:

    a) Making explicitly clear this is a second set of terms and conditions and different to the terms presented in the footer of the website

    b) Making the hyperlink the standard blue or another colour of equally suitable contrast ratio

    Another thing to ask: why go to the trouble of editing your sign-up process and neglect these important points? Deliberate maybe?

    I hope you have dated screen prints of all these different versions.

    That will be quite useful if/when you get to present your case in court.

    Yes indeed - I had a suspicion they would be making sneaky changes here and there so I've been taking a screenshot every day. :D

    Post #98 on the 26/4 says what? When I went through the 'sign up' process ~ 10 days ago the link to the hyperlink acted as like it does now when you hovered so I don't know what you think has changed there.
