It is very common for the banks to defend and now your case will be transferred to your local court automatically as all cases via MCOL start at Northampton.

Just read and read the posts regarding your own bank and you need to wait until you hear from the bank/court or even the bank's solicitor seeking further information.

hi, i am corrently claiming my bank charges back from the royal bank,

It has got to the stage were the bank has entered a defence, is this standard practice?

this is the first response I have had from the bank even though I start the claim back in march,

there defence is rather baffeling to say the least,
is there some one i should take it to to check i am not in the wrong in any way, ( i am claiming back what they have taken as charges plus interest)
or is there a facility on line to do this?

    thanks

I successfully reclaimed 2500 from Lloyds TSB and thought I would be brave enough to move onto HSBC however they did not respond so I took it to Court, this morning I received a response they intend to defend the whole claim - help!! Has this happened to anyone else - what now? Does this mean am going to Court?
  • :hello: I'm new to these forums but have been working away at the letters to claim my money. I ended up on the small claims website but Lloyds have entered a defence.
Just wondering how this now works.
Will i be summoned to court? I'm not liking the idea very much but they owe me about £1000.

I have received a notice of Transfer of Proceedings today 16.05.07
from Northampton to Hull. The questionnaire has been dispensed with .
    Reference copy
Part 3.Defence :has been filled in
Part 4 :has not been filled in
    Part5 Signed :I dont see a signature

    no court date

I intend to continue with my claim for the full £1627.89.
Lloyds TSB have paid a goodwill gesture of £750 into my account on the 19 April 2007 without my consent and this has not been removed

Any advice will be gratefully received

They done the same thing with us - they backdated the letter that said "...you have 10 days to accept the 750.00 settlement..." then when we called them to say take it back they said they couldn't. There then followed a call from the bank to say they were going to remove the temporary overdraft limit as there was money in the account and we didn't need the "special agreement anymore"    we removed the 750.00 and kept it safe so that we could return it - anyone had anything similar?? - we would really like some advice because they are defending the claim and i don't want them to get off on a technicality.
  • Barclays are defending my claim too. I can't wait to get into court. I'm going to wipe the floor with them. They've stifled my cashflow and strangled my business by effectively stealing over £3k from my bank account. I've had to sell the business and at 56 I've got to sell my house. Why do banks think that is fair to charge £30 for 1 minutes work? £1,800 per hour!!! What planet are they on? And they think that they've got a defence. They've morphed from National Institutions into Maffia. We've got to stop them!!!! I can't wait.

    Several threads for reading....

    Letter from bank/solicitor during claim

    AQ dispensed with...

    Wording for goodwill gesture letter

Have a read of the Reclaim Help Thread which is linked in my signature for links to the main banks threads, guide to the AQ and other useful threads.
