Hi,
I am in the process of reclaiming my money and have reached the following point.
I sent the notice of issue from the MCOL site on 12th April 2007 and on the letter was told that Natwest has until 1st May 2007 to reply. I received no reply from Natwest during that period so proceeded with Notice of judgement on 2nd May 2007 as they did not dispute the claim within the time period. Now since then I have received a letter from the Bank's solicitors on 9th May 2007 saying that they are defending the claim and have sent a form asking my solicitor to sign the acknowledgment of service.
My question is firstly are they allowed to do that - as it is outside of the period that they were given to defend the claim? and secondly what do I do next? - do I need to get in touch with a solicitor or what?
Some advice will be greatly appreciated.

Our bank has said it is intending to file a defence, in court. We have been told that we have yet another form to fill in from the court,(I can't remember it's name) Has anybody else been at this point, that can give us any help, as to how to word the response on this form....

The form is probably the Allocation Questionnaire. If so, the Reclaiming Bank Charges Help Thread tells you all you will need to know about filling it in. It is only to give the court some more detail than was in the online claim form, so that they can deal with the case.
You don't have to respond to the defense. In any event, it is probably little more than the usual load of "Jarndyce & Jarndyce" legal gobbledegook to try and intimidate you into giving up your claim and going away.The acquisition of wealth is no longer the driving force in my life.0 -

Got offered £1,080
Declined their offer...they paid it into my account regardless, they are now going to defend against the whole £2,750!
I have read the posts regarding the poor sod who lost!...And must say, i am mildly concerned!!0 -

i have got exactly the same from abbey today i have filled in judgement and ticked for them to pay immediatly i now await whatever comes next tthey are defending they are not admitting it and says its my fault etc so ive filled the judgement form in and send it to my local court.
