They are defending my claim

    I too have just got a letter from Natwest's solicitors,they have defended their case and today was their last day to do so! I am unsure of what to do next,the letter is very formal and ask's for further info such as dates and value of charges,I have already submitted this info in the 4 letters that I sent to the bank before going to court,is this right? And they are also saying that this has to be done by the 28th May (2 weeks) I dont really understand the letter as it is all in "law" terms,has anyone else had one of these?? What do I do next,I am unsure of who to contact.

    Im just after a wee bit of advice (and hopefully reassurance!) about my claim with the Clydesdale which is nearing the end..

    Basically, I live in England and was claiming about £2500 against this Bank in Scotland. I initially made the mistake of claiming from my English address to their Scottish one and the claim was struck out. I then discovered that they had some branches in England, one quite local to me and so with the help of the staff at the Court, I had it re-served to an English address. It all went right up to the deadline, and I thought I was going to get them on the 'Judgement by Default' routine. At the very last minute, they notified the Court that they would be filing a defence of 'No Juristiction'.

    As all this has been going on since before Christmas, I am at that stage everyone seems to go through where they think they aren't going to see there money (today's news about the out of touch judge and the Lloyd's TSB winning, doesn't help either!)

    Can anybody advise? Is this 'No Juristiction' thing normal, do they have a case and am I in for a very BIG disappointment on Monday when the deadline comes... Or are they just stalling / clutching at straws??

  • Help I have commenced court proceedings through money claim on line and have checked the status of my claim It is showing suspended, which apparently means the bank have requested a suspension. What do I do now? do I wait for the bank to contact me or do I contact money claim on line myself and ask for further information?

  • I too have checked my claim today against Abbey, and it says the status of my claim is Suspended, I don't know what this means, or if there is anything I now need to do.

    From Moneyclaim:

    '' Your claim has been suspended. This can be for a number of reasons. For example, if the claim form is returned by the Post Office not served, this will cause your claim to be suspended. Similarly, the Defendant can make an application to suspend any part of your claim.

    You cannot take further action(s) when a claim has been suspended for example request judgments' and warrants.

    Hi,

    I am new to this forum, have been browsing for months and months and using all your excellent advice on here from afar but am now in need of some help that I cannot see the answer to anywhere!

    Sorry if this is a bit long and complicated!

    Back in 2000 I was a young and silly 18 year old and got myself into some debt with Natwest bank which was partly my fault but also the fault of Natwest as they failed to tell me I was over drawn over the Christmas period and by the time everything got back to normal in the new year I was around £1000 overdrawn on an overdraft I did not have so as you can imagine they bungged on every charge known to man and it keep increasing and increasing and I was unable to pay it back. They tried to help by putting it into a loan for me to repay but the charges continued in my bank account even after that and made it impossible for me to make the required payments each month.

    To cut a long story short without warning they transfered my debt to the evil people at Intrum Justitia which made the problem even wrose as they put on charges and in the three years it took me to pay off I had endless problems with both Natwest and Intrum for example at one point Natwest were paying £5 a month into the debt with Intrum and Intrum were writing to me telling me to stop paying Natwest back £5 each month, however by this point I did not even have a bank account with Natwest and had no way of paying them so it was all a mess up between the two of them that was effecting my credit even further as the months passed despite me trying to pay it off.

    All the trouble continued until the start of 2006 when I finally battled my way through all the troubles and traumas of paying them and settled the payment. This was a massive relief and the I thought at least it would now be settled on my credit rating and I could add a note. However this was not simple either as Natwest claimed I had made a settlement with Intrum and not paid the full amount, it turned out however I had over paid Intrum and got this money back from them but Natwest were still claiming that they had not been paid in full so another battle commenced with them to get the account to say settled. I have now finally logged onto my credit rating today and seen they have settled the account so am very pleased about that but it is over a year later then when it was settled which means I have lost a year of it coming off sooner!

    I am going to add a note to my account with full details but my question for you guys is do I have any chance of claiming back charges and challenging any of this with Natwest now it is sorted as it all started in 2000 so quite a while back and I am no longer a bank holder with them. I am quite relectant to leave this as I feel I have been through quite a lot over the years in money, stress, my credit being damaged (Everything else on my credit is perfect!) to just leave it!

    Can I suggest that you post this in the bank reclaim forum where the experts are based?

    Can I also suggest that you put some paragraph spacing in your post to make it easier to read?

  • If the bank and/or court want further information they will write to ask for it.

    Could this be a reason as to why the chap lost yesterday? I too haven't sent any defence for son's claim but am now waiting for the court date as it has been transferred to local court. This transfer info was sent by Northampton on 5th May.
    All advice is greatly received and I can understand everyone's concern.

    Short answer si yes You can claim even though you no longer hold an account with them. You can currently claim back to May 2001. Have a look at the claiming bank charges threads.
