The original search warrant was not gained against Megaupload but ninjavideo.com which was piggybacking on megauploads service. Megaupload complied with US law enforcement keeping quiet about the warrant and also handing over evidence of copyright infringement. Megaupload was protected by law as being a service provider.
The US refused to hand over copies of evidence to his defence team claiming "it was too complicated to". They are using civil copyright laws as a basis for a criminal case. A New Zealand Judge refused a US extradition request because of that.

but how many people lost access to their files etc and still dont have access to them when megauload was taken down. his new site could end up the same why do you think he has the new site hosted offshore rather that the USA

That is a risk you take with any form of storage both online and offline and is why you have multiple backups.

He has the new site completely out of the USA so they cannot pull this trick again. They used the fact he was using a .com domain as justification for being under the jurisdiction of the USA.

it was not just this as megaupload was hosted in a USA datacentre, thats how they were able to take control of the domain and take the site down.

he moved offshore with the new site to avoid DMCA and the FBI, but if he starts his old tricks again the authorities in NZ can still have his .co.nz domain taken down. but why trust a site by this guy again after megaupload

The "domain" had nothing to do with the location of the servers.

The fact you don't know this seems to undermine your knowledge of everything else involved with regards to this case.

Make no mistake "kim dotcom" is an utter !!!! but it doesn't mean the FBI should be getting involved in civil enforcement on behalf of the RIAA or MPAA.

I don't use his services, i never would use his services but the FBI is supposed to investigate crimes that cross State lines within the USA.

KDC doesn't live in the US and I've yet to see the FBI or anyone supply any evidence that he has broken laws on US soil whilst having a business located there.

Quite a large proportion of the seized servers were not located in the USA, if any? This is why the US just had an overly broad data search squashed by the Canadian judiciary (the data they are after is in Canada).

Likewise the NZ Judiciary have just squashed the US over the utterly shambolic way they went after him in NZ. In fact it appears they themselves may have breached NZ and international laws in doing so.

I'm not an apologist for KDC, he is the worst of us in many ways but don't for a second believe the US and its agencies are behaving in a better manor than he is.

If any of his server were located in the USA as some where then the FBI has justification to seize these and any others linked to them from anywhere in the world. they work with interpol etc .

Yet they have still levelled no charges against the man or his company.

Failed to get any data from Canada as the search request was too broad (basically a fishing expedition).
* Why do they need to have all the data when they know exactly what he has done wrong?
* Why don't the servers in the USA carry all this data?
* Why won't the government return the actual legitimate stuff stored on this service if the end user can prove they own it?

Why also have they:-

Failed to get the NZ judiciary to back them with regards to seizures or, in fact, the freezing of KDC accounts.
Failed to provide any semblance of anything they've leveled against him in the media.
Generally failed to do anything about him or his "illegitimate" business services?

Could we suggest that the US agencies have gone off half cocked?

Where we currently stand is that the US law enforcement agencies have made KDC look like a victim and made you look like an apologist for their utter inability to get the job done properly by the rules the government have made.
