Yes but inadvertently breaching copyright with file hosting sites. They were designed to simply transfer documents from one user to another, obviously they were never meant for movies or music. In reality, what they are offering is perfectly legal, what users were using them for was illegal.

As for torrent sites, exactly the same thing. Torrent sites do not host or supply anything. They are simply an indexing site.

Ironically, the worst site of all for illegal download links is google....

yes but it al depends how you react when you are approached by authorities.

Mininova changed their system so the only ones allowed to post torrents are the actual file owners and piratebay just took their site down. I believe megaupload ignored such requests to clean up their site and put in place features to stop the distribution of copyright material, hence the FBI too his site down for

    Racketerring
    Copyright Infringement
    Money Laundering

It's a bit more complicated than that...

The new Mega has no servers or presence in the US and is fully encrypted so it'll be a huge challenge for the FBI (sponsored by Hollywood) to take it down.

The whole reason he's able to setup another service is the FBI and New Zealand government broke their own laws to shut him down the first time around (illegal spying, incorrect warrant for the raid, FBI taking his property out of NZ without permission, etc.). It is quite possible he will end up winning the ongoing legal battle.

Technically there is no such thing as a 'file owner' with a torrent as often the data itself is just found elsewhere so 'technically' again noone is breaching any copyright. Are you aware exactly how torrents or nzb's actually work? Just wanted to check as these sites don't offer or supply anything. They work exactly like google does.

In terms of the pirate bay, of course they didn't simply 'take their site down', their argument was as above all along and rightly so in my opinion. Same with newzbin and newzbin 2.

So I just think rather than shouting 'breach of copyright' etc. you need to confirm you are aware exactly how this type of site works as the whole thing is questionable once you are in that position.

To confirm I'm not 'pro piracy' at all, I just think there's a lot of random allegations banded about when even the authorities don't know exactly what they are arguing against.

Quite possibly the US will persuade the NZ government to hand the bloke over to them for trial and/or shutdown the new site.

What are they going to use for evidence? All the data is sent encrypted at 128bit and then is 2048 bit encrypted on the servers using a unique key.

They're not opening that without the key which the account holder only has access to. And if an account holder suspects they might be in trouble, simply changing the account password makes the decryption key completely unusable.

The NZ govt won't have anything to do with this after learning that the US law enforcement agencies lied to the NZ courts and effectively broke the law in regards to Megaupload.

In short, he's almost created the perfect online storage for now. He can genuinely deny all knowledge of what is on there and the only people who are at risk are those who upload files to their account and then share their key with others they let download from that account. All the risk has been transferred from him to the users of the service. Oh and if you read the T&Cs, he's made you liable for any legal costs he incurs if you are investigated.

Theres a lot on misinformation and just downright rubbish being sprouted in this thread.

BEWARE a new cloud storage, with encryption and 10 times more free storage than its competitors. Its created by the same guy who the US government, after lying to courts in the US and NZ, shut down causing 1000's of law abiding people to loose all their data (and by shut down I mean stormed the guys mansion like his was osama).

    Seriously???

Since when have the US been concerned with such niceties?

    Strangely...

  • Why should i be warned. I will be signing up once i can get on the thing. In no way what he was doing was illegal. He provided a service(mega upload) just the same as google drive, dropbox,Skydrive. At the end of the day its up to the users to adhere to the TOS.

I would pay £50000 to anyone who could prove some people using Dropbox etc, that they don't use it for illegal file sharing

If you mean pay £50,000 to someone who proves they don't use dropbox for illegal sharing then you owe me £50,000 :)
