Son injured at nursery!! X

Hi I am just looking for some advice.

I had a phonecall from my sons nursery yesterday telling me he had hurt his ear and needed to go t hospital. When I arrived I noticed that he had sliced his ear open. I took him down to our local a and e department which they found out that something had actually gone through his ear into his head behind the ear.

I've spoken to the nursery and they are telling be that he had fallen of a little bench into a dressing up box which only had a soft play mat and a plastic rounded edges plate. I went in the nursery today to look we're abouts he had fallen and notice that everything around what he could of hurt himself on was all smooth edges nothing was around that could of went through his ear. The nursery manager is doing a full report on this and I will be given my own copy. She said that she is even going to phone up ofstead and notify them of what has happened. I don't believe there version of events as like I said noting could of gone through his ear. What do I do now. What are my rights and do I phone ofstead myself?

    If their version of what he injured himself on varies from the hospital report, you'll have to challenge them on it. It's always possible that the nursery manager is being lied to by the staff on duty at the time.

    Did you speak to the member of staff present when it happened?
    How old is your son? Can he tell you what happened?

    How horrid, and that the object that caused this is a mystery. Were the hospital able to give you any clues as to what it might be?

    Its hard not to be suspicious and worry that the nursery might be covering their tracks because of a lapse in safety. These things happen in a split of a second, are they saying the carer saw it actually occur. If their back was turned or they were dealing with another child it may not have anything to do with the playbox. He may have fallen into the playbox because of the pain/shock of injury happening nearby.

    I'm wondering what the nursery will put in their report though if they themselves are unable to say what caused it.

    I hope your son is on the mend and you get to the bottom of it.

  • I am only guessing that the report will only say what they have told me. She said that after the full report of the incident that its upto me what I do. This is where i don't know what my options are and neither does she. She said that she has never been had a child injury themselves so much that he has to go to hospital. I am awaiting the hospital report my doctors are trying to speed things up for me to have it. She had said that she was filling all the accident book out I havnt sighed anything which usually I do. Can ofstead get the hospital notes without my consent?
  • My son is only 2 and half years old so can't really say what happened. The two carer's had there back turned. 1 was doing snack and the other one did go over to my son and asked my son to get down and he said no so she turned her back and aparantly as she was walking away she heard the scream and turned round and he was in the box
  • All the nurse had said that something had sliced the ear and then went through his ear. She couldn't think what would cause his injuries either

    Although accidents do happen I would be inclined to take some pictures of the wound in case you decide to persue the matter . I hope your son's ok .

    It is perfectly viable that the nursery is telling the truth (or not).

    Was there other children around? You would be suprised what zips, end of buttons and other items on a child's clothing can do. Earnings of another child (the sharp back) when the fall on another child etc.

    I would bet some dressing up item had a sharp point (ask them to check)

    At 2.5 he *may* give you clues but they can also give a lot of red herrings.

    OFSTED will register a safety complaint against the nursery and may do a spot visit. They will not contact the hospital.
