As your son went directly to hospital, the nursery legally have to report this to the Health and Safety Executive who will then pass on the notification to the local council who will investigate the accident. I would be asking the nursery if they have reported the accident and if no, why not. If they still don't report it I would contact the council and they could prosecute the nursery for that isue alone, nevermind whether there were any health sad safety failings.0

I work at a pre-school and we have lots of minor accidents every week. Children slipping over, banging heads etc. If you do not actually witness what happened it can often be hard to work out exactly what did happen from a 3yr old.
We have only had one accident (in the last 5+ yrs) in which the child needed to go to hospital. He was running, had been told to stop, started again, tripped and hit his head on a rounded table leg which split his head open. We have a very high staff ratio where I work but you can not watch every child every second.
Your child's injury could have been caused by the plastic plate/box - the force coupled with a childs soft skin.
I remember splitting my cheek open when I was 4 yrs old just bumping into someone.
Does the pre-school have a good reputation, Ofsted report?, Were you happy with the pre-school before this accident? Is your son happy there and are the staff approachable?

OP I have read your description of your sons injury and can fully sympathise with your distress. My oldest boy suffered exactly the same injury when he was slightly older. He did this by piling all of the cushions, blankets, pillows and duvet up on his bed and then attempting to do some sort of leap/dive onto the sofa bed opposite his bed. The sofa bed in question was one still sold today by John Lewis which has no arms and is padded on every exposed area. I still don't fully understand how this caused the damage that it did but all the same it did. It doesn't need to be anything hard or sharp apparently the force of the impact is more relevant than what was collided with, or so the surgeon told me anyway.
For anybody thinking what a terrible parent I am for letting him get injured like this we lived in a flat at the time and his bedroom was on the other side of the wall from where I was preparing dinner in the kitchen so naively thought I would have time to intervene if anything untoward was happening.
If it helps any my son is now 13 and you can only see a very faint white line if looking closely when his ears have gone bright red in the cold.0 -
It also happened to my ds at nursery. He was running, fell over his own feet and split his head open on the corner of a wall. You would have thought he had been cut with a knife the wound was so precise. The staff looking after him were distraught. I too was quite upset as I thought nursery should have looked after him better, that is until a month later when he ended up with his second set of stitches in a month in our care! He picked a fight with a floor this time!0

I would understand if he had fallen and had just spilt his ear but his injury isn't just a spilt it looks like something has gone right through his ear lobe. I will be just waiting for the full report and see what I do from there. He has been pulled out of nursery until I decided what to do
