    I'm not aware of a single person who has succeeded in claiming beyond 6 years. Because the airlines can say no and you can't do a thing about it.

  • Thanks for the replies I will get to read the guide when I get back.

    The flight was eventually rescheduled and was then delayed another hour.

    I will check my insurance company to see if anything is claimable there.

    We were given a letter from Virgin and the pilot on the flight was the same one from the previous day both saying crew were out of hours which is why flight did not take off eventually, so not sure if there was a slot as we were sat on the plane on the runway for 3 hours before they abandoned and started mentioning crew hours?

    I am now back from my holiday and looking to pursue this.

    I understand that the weather would mean that it was extraordinary circumstances and this would mean no compensation payable.

    However i spoke with someone else on the flight who was also told some other information.

    The pilot was heard saying outside the "premium economy" that if the flight didn't take off at 5 it wasn't going anywhere... they were still loading people towards 5 o clock and never even checked boarding cards - as it was clear to us we were being herded on board to eat the food so it didn't waste - which was cold unappetizing and we were given half a glass of water with it. He was also saying the the deicing equipment - which apparently only 2 were available on the whole airport wasnt fit for purpose - it was a dribbling hose and not deicing anything so once again it was clear we were not leaving the airport.

    The plane itself had been on the airport since 7.30 am other flights took off after 1.00pm including a hong kong flight which only had 1 hour delay and was due out at 12 and took off at 1??? Other flights to spain also took off after the airport reopened at 1.00pm.

    We were given a £5 food voucher at 12 o clock and the above poor meal and half a cup of water about 6 o clock and nothing until the following morning at breakfast, we were offered nothing at the hotel except the usual coffee in the room (i dont drink coffee or tea) until breakfast. - we were shipped out to Liverpool.
    No virgin staff were at the hotel and nor did anyone come in the morning, we were told on the evening just get on a bus - no idea where to etc etc. The hotel put a board up to say pick up was 9 am the following day but there was absolute chaos when the coaches started to arrive - never seen so many older people push and shove. There were not enough coaches and they had to call for more as people had too much luggage for the coaches although seats were empty.

    The pilot then explained we were out of crew hours, well taking off at 5 would have meant out of crew hours so i am guessing it was never going to happen. The letter given out by virgin also said was due to crew hours and not weather?

    so i guess i want to know if i just go onto virgin atlantic website and complete the feedback or do i put it in writing to the customer relations dept? Can i claim for 4 people as one group or do i have to do this individually? I paid for 4 flights altogether on one booking?

    I have an on-going issue with a Virgin flight and wondered if anyone else had been through the same or had any advice.

    I made a claim for flight VS074. This flight was 25 August 2007. Our claim was made within the 6 year period and rejected by Virgin on 28 March 2013.

    I then escalated matters to the CAA who told me that due to their own workloads that they would not be able to look at the matter until after the 6 year period had passed!! I tried, without any success, to ask why their inefficiency should impact me but the claim just fizzled out.

    On the back of the court ruling I have approached Virgin to state that their initial rejection was wrong and they should re-open the case.

    At the moment they are stating that as my request to re-open comes outside 6 years of the flight and therefore beyond the UK statute of limitations.

    I am prepared to go back to them on this but wonder if anyone else had come across this and/or if they had any success.

    'Claim'means issuing legal proceedings, not writing a letter. If legal action was not begun before the 6th anniversary, you are out of time.

    LHR - CAPE TOWN Feb 2012 flight delayed 12 hours due to " technical problems" was given overnight accommodation and £30 food voucher.
    After a moan got 25,000 virgin miles and a invite to Virgin lounge for next trip.

    WASHINGTON - LHR Feb 2015 flight delayed for 27 hours hours due to "technical problems". Not put in complaint yet as only last Thursday departure.
    Pre warned me 17 hours before and no offer to re route me or back on another airline.
    Will I still be able to claim for the 2012 flight even though I accepted the air miles ?
    I am a virgin silver tier member and have been for last 6 years.

    Depends on the wording they used to settle the 'moan'. My guess is that back in 2012 they won't have used any language to say if you accept these 25,000 virgin miles then that is in full and final settlement of your claim, and by accepting these, you are therefore agreeing that there be no further claim under EC261/2004 regs. If they didn't use anything like that then you should be ok to have a go at a further financial claim for compensation.
