  • Thanks for the replies I will get to read the guide when I get back.

    The flight was eventually resceduled and was then delayed another hour.

    I will check my insurance company to see if anything is claimable there.

    We were given a letter from Virgin and the pilot on the flight was the same one from the previous day both saying crew were out of hours which is why flight did not take off eventually, so not sure if there was a slot as we were sat on the plane on the runway for 3 hours before they abandoned and started mentioning crew hours?

    So by definition your flight (VS073) was effected by a knock on delay.

    Due to the length of the incoming flight from Orlando it also seems plausible that the flight crew were out of hours etc etc

    Which all means you are entitled to claim 600 euros for each of your party that qualifies. See Vaubans guide for more details.

    My own claim is also as a result of a knock on delay although down to a technical problem with the plane, my case against Jet2 is currently awaiting the test case 'Allen' at Liverpool this month re Van der Lans and that's why I say it's not straight forward, my case would appear to be stronger than yours (tech prob) but after almost 2 years im still stuck in the legal system

  • I was delayed 5hrs 51mins in January 2010 on a flight to Barbados from Manchester. I have twice (first on 15/11/14 and again 29/12/14) submitted the correct Virgin form downloaded from their website to claim delayed flight compensation and have not received a reply. What should I do next please?

  • I have read the guide and it is very interesting and I feel I could follow the steps. However, if Virgin hasn't even replied to my form and allocated me a reference number, which they promise to do on their website within 28 days, what are the chances of them taking any notice of any other communication? Do you know if their tactic is to ignore everyone, but the most persistent?

    Many airlines will mess you about until you show them that you are serious by sending them an NBA or involving a NWNF solicitor.

    Don't get distracted by their delaying tactics.

    Even NBAs seem to be ignored, in truth. So serve court papers on them, as my guide suggests. If they ignore those, then you get to send in the bailiffs ...

    Jill its also about ensuring you have followed the correct procedures pre court. (not that the airlines follow CPR guidelines/rules with any conviction.....)

  • Well guess what? I have today received a reply from Virgin and ...'having reviewed my claim they regret my claim has been denied because of exceptional circumstances'. At least I'm happy to have my forms acknowledged and can now decide whether to proceed. My husband is reluctant to continue, but I'm not sure.


    Yes we were delayed by weather conditions - light localised snow at Manchester airport forced the incoming plane to divert to Birmingham. Crew out of hours so time delay of 6 hours was caused by getting a new crew to fly the plane up from Birmingham. Planes were taking off from Manchester at 12.50 when we should have departed. I can see the snow was EC but not the long delay that occurred. What do the experts think about this please?

    This wasn't vs73 on the 4th of April 2012 is it? I've got the same story as you where I have heard nothing yet since December but I sent a letter before action to them yesterday as if it's the same flight I think we have a fair claim as technically our plane wasn't delayed due to weather etc it was the inbound flight that had the problems therefore If they reject mine I personally will be putting a claim in after the 14 days notice expires via mcol....
